Court Upholds Cake Designer’s Religious Freedom Rights to Refuse Request from LGBT Couple

The California bakery owner was targeted after a lesbian couple asked her to create a wedding cake and she referred them to another baker because of her sincere religious belief that marriage is intended to be between one man and one woman.

(Thomas More Society) — Cake designer Cathy Miller has been vindicated in the California courts for practicing her Christian principles on the job.

On October 21, 2022, attorneys from the Thomas More Society brought home a First Amendment victory for the cake shop owner of Tastries, a popular Bakersfield, California bakery that was targeted by gay activists. The ruling, handed down by Judge Eric Bradshaw of the Superior Court of California in Kern County, decided for Miller in a lawsuit brought against her by the Department of Fair Housing and Employment.

“We applaud the court for this decision,” stated Thomas More Society Special Counsel Charles LiMandri, partner at LiMandri & Jonna LLP. “The freedom to practice one’s religion is enshrined in the First Amendment, and the United States Supreme Court has long upheld the freedom of artistic expression.”

Miller had been the target of multiple lawsuits after a lesbian couple asked her to create a wedding cake and she referred them to another baker. Miller’s polite refusal to design a custom cake for a homosexual union was rooted in her sincere religious belief that marriage is intended to be between one man and one woman.

The legal action against Cathy’s Creations, Inc., brought by the Department of Fair Housing and Employment was filed under California’s Unruh Civil Rights Act, which provides protection from discrimination by business establishments on the basis of race, ethnicity, or religion.

I have no problem with a florist refusing to provide flowers for a gay "wedding"...or a normal wedding. I have no problem with a florist refusing to provide flowers for a black wedding...or a white one.

I do have a problem with an ambulance company refusing to transport a gay person...or a normal person. I do have a problem with an ambulance company refusing to transport a black person...or a white one.

It's a question of urgency. Flowers aren't urgent...an ambulance is.

I suppose the phrase "intended to be between one man and one woman" renders the phrase accurate.

However, historically, if you changed it to be between men and women, you cover all bases.

I have never heard of "marriage" historically, anywhere, which was between same sexes.

The Romans had a couple of satirical examples, which were never in law.

There are plenty of examples of same sex consorts..., but never marriage.

Marriage was always about the potential to produce children, something impossible for same sex pleasuring.

Polygamy, plenty, very common.

Polyandry, only one example I know of, in Tibet.

The vast majority: one man and one woman, with a significant minority of one man, and a couple or a few women.

The Department of Fair Housing and Employment brought the suit, so she would be suing the taxpayers. The government hacks who filed the lawsuit wouldn’t be chastened.

Been suggesting it for years, so might as well say it again;

Why not simply include one short part of the Bible verse on EVERY cake...maybe even near the bottom.

...with no option to not include it.
Every cake has the words.

A whopping, seven-figure Civil Action citing gross Religious Persecution would be fine by me, so long as TMS would bury it to the hilt.

TOO many times I’ve seen cases like this settled for pocket change on the fetid argument that it’s “a matter of vindicating principle,” not punishment.

Well — NEWS FLASH!!! — when the would be oppressors are not in excruciating fiscal pain on their way outta the courtroom, they or their ilk will be back, again later.

The ONLY way to quash this BS is to ensure that it is BANKRUPTED at EVERY POSSIBLE OPPORTUNITY.
