Look, I'm pretty ticked off, and you are, too.

I also agree with you about the fact that at some point, we DO have to stop caving, but tell me honestly, who do you think is in a better position to make that call as to where the line is drawn? Folks like us on an internet forum posting their opinions from places like Atlanta, hundreds or even thousands of miles from the action, OR the guy on scene - in this case, Senate Majority Leader Frist?

I believe I have no more business telling Frist where to draw the line on this issue than I do of telling Ned Yost how to handle in-game decisions for the Brewers against the Cubs this weekend in Milwaukee. That's how I see this. Frist ain't no slouch - he friggin' got us to this majority as head of the Senatorial Campaign Committee - or did you forget about that already? It's only been ten months since he pulled THAT one off - against the usual historical trends.

In my mind, President Bush has set the tone for the WoT, The war in Iraq, tax cuts, etc. Judicial nominations should not be any different. He actually took a very strong stand earlier this summer when he pledged to support Estrada til the end- and managed to make the Democrats look small too. Bush had every chance to use the kahunas we know he has to get this man on the bench. He didn't. And for that, I am sorry because we've lost a good conservative who could have done great things.

The other problem is this. If the Dems blocked Estrada, do you really think they'll go for anyone more conservative than Estrada? There's no way in hell, which means we have to once again play the game of picking a judge who's more liberal. In the end, we all lose- except for the Dems.

I still wait patiently for the "Bushbots" and the "Republicans can do no wrong, give them more time, blah blah blah" crowd will finally realize that there is no difference which party is in power. Were things all that different when Clintoon was in office? These politians rage at each other, but , under-the-table, they are winking and shaking hands. There is NO difference between the two, but they have their supporters SO SCARED of the other party that they know we will shrung and CONTINUE to vote for them. Lesser of two evils, you know. Maybe,...someday,...the Bushbots will see,......someday.

Another Bush defeat, a conservative would have pushed harder. But Bush is not a conservative, he is a moderate.

Look at the whole picture. Moderates make up about 60% of the US population. If the Republicans can gain the majority in the Senate by claiming to be moderate and ad hoc vote for some meaningless liberal issues, they will have the power that James Madison once said would never happen.

A 2/3 control of the three branches of government by one political party would end the strife to acomplish their agenda. Though control of the states as well would definitely nail the coffin shut on the liberals, it's not needed when the courts can be controlled by the other two branches of federal government.

Owen is ahead of Brown, I meant Brown will be the new target, particularly since she's appointed for the DC Court, which Estrada was, so there will be pressure to get someone confirmed here.

A lengthy filibuster would not have changed one thing and would have polarized the Senate even more and important work would not be accomplished.

In my opinion, bogging the Senate down would be GREAT! I consider very little they do to be "important work".

I hope Bush nominates a "stealth" conservative to the SCOTUS as a pay back, the mirror image of Souter.

The anti-Souter would have a moderate record on his current résumé, but once he gets to the SCOTUS, he will make Thomas look like a left-winger.

I see your point, but Owens is in a substantially different situation: she's already a judge. She doesn't have to trim down substantially what she does or says, as Estrada has had to do with his law business, while awaiting (and awaiting ... and awaiting) a floor vote.

Recess judicial appointees aren't paid anything. Estrada may have a mortgage and other bills to pay. Now, what about putting Bork in there? He's got money enough ... *L*
