I don't agree with the Judge that this is one of those issues which require disbedience. If a life was at stake or some other imminent danger then the story would be different. Heck, God took his sweet time before giving his people these commandments, a few months wait wouldn't matter.

Story may have been appointed by Jefferson, but his decisions very much support federal power. Unlike, say, those of the Jacksonian Taney. You could certainly have a federal system where the power of the Supreme Court to command state courts is much more limited than it is, and nevertheless federal law -- in the sense of the U.S. Constitution and federal statutes -- is regarded as the supreme law. State courts apply federal law all the time.

In any case, those cases concern the power of the Supreme Court to command state courts. Here we have the different issue of the power of inferior federal courts to command state courts. I don't see how that's obvious under the Supremacy Clause.

He doesn't have the right to remain a judge and defy a court ruling. That's the bottom line. If he can't live with the rules of the judiciary, he does not belong in it.

Are you saying that you want the U.S. to be a dictatorship ruled over by the Supreme Court? What the court rules, goes?

He may not have chiseled the monument, but he's certainly has stated the intention of planting it where it is.

Would your opinion be diferrent if he said he was an atheist and he displayed the monument to show how irrelevant those ancient laws are ?

Listen, its nuts to judge whether something is religous on the basis of the intent of the artist.

What if a judge said he worships the law and that the gavel he holds in his hand represents his religion. In fact the judge believes that all lawyers should likewise worship his gavel? Would the gavel need to be removed ?
