SACRAMENTO -- Last week, Governor Gray Davis signed AB 703, authored by
Assemblyman Mervyn Dymally. Regrettably, the Governor has chosen to renege
on a campaign promise to the people of California, made during the 1998
gubernatorial campaign when Davis stated that he would do nothing to
undermine the will of the people regarding the enforcement of Proposition
209, now Article 1 Section 31 of the California Constitution.
AB 703 not only undermines Prop 209; it eviscerates it.
This bill calls for the identification of racial minority groups and directs
the government to grant "special measures" to further the special interests
of said identified groups. The measure states further:
"Section 31 of Article I of the California Constitution shall not be
construed as requiring the government to prove racial discrimination before
undertaking special measures for the purpose of securing adequate
advancement of those racial minority groups needing that protection..."
That is the opposite of what the people of California approved by a margin
of 55%-45% back in 1996.
Candidate Davis promised to defend and uphold the California Constitution,
as amended by Proposition 209; yet Governor Davis is trying to eliminate it.
One might wonder why the Governor has flip-flopped on this issue. Does the
word "recall" ring a bell?
Add Davis' support of racial categorization, as reflected by his opposition
to Proposition 54, to his clear demonstration of support for racial
preferences, by signing AB 703, and the Governor's desire to divide the
people of California on the basis of race and ethnicity becomes apparent.
Statement from Ward Connerly:
"I am shocked that the Governor would flip-flop on an issue such as this.
AB 703 is clearly an illegal maneuver to change the Constitution by statute
and grant preferential 'special measures' to racial groups without proof of
discrimination, a blatant violation of Proposition 209. I am pleased that
the highly respected Pacific Legal Foundation will be filing a lawsuit on my
behalf challenging this nefarious attack on equality. Now the taxpayers of
California will have to pay, one more time, to defend the Governor's
inability to exercise leadership by vetoing a clearly illegal act of the
legislature."

Yeah, me, too. I'll watch the alerts more closely from
the RPI person who sends mail to me and try to get them
here quicker.
But isn't your Assembly out there in Cali. likely to pass
something like this, regardless? Aren't they mostly
Dems? If so, about the only sort of thing you might even
prevent is one of their budget fatties.

Is this the state equivalent of the 'toon signing off on all those questionable "pardons for pay"? We certainly can see the fine hand of one former impeached president here, can't we? The advice from 'toon must have been, "Okay, so you're on your way out, don't forget to do favors for your friends while you're still in power. The other side can't do anything about it but scream."
Maybe it's me, but this is the clearest signal yet that Davis MIGHT resign before the election, which, although it doesn't stop the recall, does throw the voting public into turmoil. Think of the opportunities for leftist disinformation!!

Gray Davis pandered to the extreme Left in signing a law that contravenes the California State Constitution. Ward Connerly and the Pacific Legal Foundation will file a lawsuit to get get the unconstitutional law overturned. This blatant disregard for the state voters on top of Davis giving consent to civil unions which contravenes the letter and spirit of Proposition 22 are both reasons why The Doofus HAS TO GO!!!
