Courts refuse to stop S. Florida abortion
By Anthony Colarossi Sentinel Staff Writer
Posted May 28, 2003
A Central Florida group lost two court battles Tuesday to stop the court-ordered abortion for a severely retarded South Florida woman.
First, Circuit Judge Arthur Rothenberg in Miami denied a request from the Liberty Counsel to stop the abortion, which could occur as early as today. The counsel then appealed to the 3rdDistrict Court of Appeal, which also rejected the group's motions.
Late Tuesday, Liberty Counsel officials said they would appeal to the Florida Supreme Court, which was not expected to rule before today.
Referring to the woman's fetus as "Baby Doe," the Liberty Counsel said in court papers that it wanted a guardian appointed to represent the unborn child. Those requests also were denied by the two lower courts. Officials of the group think the abortion is scheduled for today.
"This pending matter involves immediate and irrevocable issues of life and death for Baby Doe if the trial court's order is not stayed and this appeal is not expedited," the group wrote in its emergency motion to the appellate court.
The South Florida case and a strikingly similar Orlando case have raised difficult questions about how to deal with mentally disabled women who become pregnant in state care.

PLEASE REMEMBER THERE ARE TWO CASES INVOLVING ABORTIONS AND PREGNANT DISABLED WOMEN IN FLORIDA.
Gov. Jeb Bush has gotten involved in the one with the 22 year old, who has no family to speak for her.
THIS is a different story! THIS story concerns a 28 year old mentally disabled woman pregnant at 23-24 weeks with severe brain seizures whose doctors chose not to follow through with a scheduled abortion as they determined no health risk for mother or baby at the time.

Scarborough covered this tonight, as well.

It is a sign of our times ... a criminal commits a criminal act against a handicapped woman, thent he courts authorize killing the innocent child conceived during the criminal act ... like the state wants it all to go away and the bloody method to make it so is of no consequence, after all, women are still getting preggars so there'll be more kids around. America is reaping what it deserves.

America is reaping what it deserves Some of it, yes, certainly. The rest of Us (I know which side you're on... ;) )... well hubby thinks this will eventually lead this country to another Civil War. I think he is correct. I consider abortion to be our generation's Holocaust.

Welcome!
I really admire Liberty Counsel's stand in this case. Though I have no faith whatsoever in the FL Supreme Court, I can only hope that this little one will not die in vain.
LC is showing that though this woman's story is tragic, the baby can be saved, but won't, by the system. So not only was the mother neglected (raped while under system's care), the baby will now be killed by the system as well.
The abortion they want is equally dangerous at this 6 month stage as a C-section is. Either way the judge ruled her tubes must be tied. They both require major surgery.
I wish they would allow the baby to live and be adopted out. I don't hold out hope, and it breaks my heart.

Thanks for the ping. So sad. I would take her baby without question, assistance from the state, whatever. That precious child is nearly viable outside the womb. Why not just deliver if there is such a rush? God forgive them.

So Sad, one life snuffed out in utero and another put at risk of getting breast cancer 10 yrs. later. There are many couples who are waiting to adopt a baby here in America who could have raised this child.
