Man strikes plea deal in rape of 15-month-old

A Strongsville man who faced life in prison if convicted of forcibly raping a 15-month-old girl and molesting her infant brother struck a plea deal yesterday and got an 11-year sentence instead.

Paul Kaforey, 38, pleaded guilty to one count each of rape and gross sexual imposition, but prosecutors dropped the indictment's claim that he used force.

The plea bargain came on the eve of a hearing to determine whether Strongsville police legally searched Kaforey's home when they seized evidence including videotapes and photographs of Kaforey engaging in sex with the girl and the boy, who was less than a year old.

Cuyahoga County Common Pleas Judge John O'Donnell handed down the sentence, and also declared Kaforey a sexual predator. That will require Kaforey to report to police every three months after his release.

Assistant County Prosecutor Michael Sullivan said the children's mother approved the plea bargain.

No, I did NOT just read the headline; I always read articles to which I reply. I just re-read it for the third time, and it still doesn't make a lot of sense. Bungled justice, I suppose.

He wouldn't get an 11 year sentence. He'd walk free. That's why he got the plea bargain.

I'd change that to "probably wouldn't get an 11 year sentence" and "probably walk free".

If it were for certain, his lawyer would never have agreed to the plea bargain.

Bungled justice, I suppose.

If there was doubt the search which procured the evidence was legal, the risk may have been too great that it might be thrown out, resulting in no conviction at all. Nor does that necessarily reflect anything negative about the police; they may have had no other option but to search in the manner that they did.

Agreed if that was the only option. It just seems that there is so many loopholes for the defendant to take advantage of to avoid justice. Without knowing why the search was in question we can only guess why the prosecutor offered the rapist a slap on the wrist. The bottom line is that a person who raped a 15 month old baby will be out to rape again in 11 years and justice was not served.
There are many cases where the police do everything right, and the rapist gets a slap on the wrist, ordered to counseling, and is back on the streets to threaten my child's safety. I was just notified last month that a convicted child molester (5 yr old chd) moved into my block after a very short sentence. I live in liberal King County (Seattle area) and am fighting the Dept of Social Health Services (DSHS) who want to build a sex offender unit within 1 mile of my house and my daughter's elementary school. The sex offender housing unit would house the "worst of the worst" of the sex offenders. These are people who have been convicted of a sex crime, and have been evaulated as "high probability to reoffend" but their sentences have been satisfied, so they cannot stay in prison. I want to know why these cretins were given short sentences in the first place and also, why is the DSHS insisting that these "people" be placed into a residential neighborhood instead of an industrial area, or an island. The DSHS told us that by placing these scumbags into a non-residential area, they would not be integrating them back into society. My neighborhood appears to be winning the fight, but that just means my child will be safe, and someone else's child will be at risk.

What a terrible thing to have happened...

My own opinion is that no pedophile, once caught, should ever be able to leave jail...they cannot be rehabilitated, and when they get out of jail, children are automatically at risk, if they are anywhere near these monsters...

There may be the rare pedophile that can be rehabilitated, but that is not the norm...I would rather that those few possible rehabilitated pedophiles remain in jail, rather than placing thousands of childen at risk for being raped...

Somewhere along the line, the legal system changed it's top priority from protecting the most vunerable among us to "rehabiliting" the sickos and developing new programs to integrate them back into the community.

Actually it seems to me we've largely given up on rehabilitation for just about anybody. In this case there was a good chance this guy would have gotten off scott free if the DA hadn't offered this plea bargin.

Maybe she figured it would take less than 11 years for the prison population to find out what this guy was in for.

I am A mother of an 18 month old boy.and if someone EVER put their hands on my child in an Inappropriate manner.there would not even have to be a trial i would kill the SOB myself.I cannot believe that the mother agreed to that sentencing.

There has got to be more to this story than what was reported here.

Was the mother in on it? It happens. I know of a case where both parents prostituted and loaned out their own infants and social services kept giving the kids back to them. One more piece of proof that our government is broken, IMHO irreparably so. There is no excuse for things like this going on. None, period. No technicality crap. No "mitigating" circumstances. Nothing.

Any rape should be dealt with by death for the rapist. There is no, absolutely NO excuse for forcing oneself on any unwilling individual.

There is no excuse for any this or any unprovoked crime of violence and regardless of how anyone spins it, death is the only response that stops the danger. If I were the father of this child, I would make certain this beast never harmed another child when he was released if it meant my own death in the process.
