I don't think this forum's mission is to sign petitions that are advocating unconstitutional measures.

Providing for the common defense is Constitutional.

BUMP!

As for those who believe the Constitution is protecting us, bear in mind that the Constitution protects all PEOPLE, not CITIZENS who are within our borders. Hence the dilemma of being able to literally kill Taliban outside our borders, but not being able to listen to their phone conversations if they make it here.

The President needs no act to deploy troops to the border he has that authority as CnC. I'd simply instruct the military to shoot anyone who tries to illegally cross the border( they are not citizens and thus have no rights).

Read the Posse Comitatus Act

I fail to see how an act of Congress can make providing for the common defense unconstitutional. Congress cannot change any part of the Constitution by a legislative act, nor did they intend to do so with this one.

The military is precluded from assuming police enforcement in the country absent martial law. Tell me. Does it not make more sense if we are going to use the military, use it to round up the illegals already here. If you multiply the "Elian photos" a thousand fold, then no one is going to be crossing the border to mow lawns any more. That way the Border patrol can concentrate on those still trying to cross which may be a terrorist threat. If we are serious then make an example of those that are here. Change the petition to demand martial law then the illegals have no recourse in civil laws such as deportation courts. Show them dragged from houses by the Marines. All of those wetbacks would think twice then right? The clear and present danger is not the ones crossing tonight it is the millions already here.

It's amazing how some people here are against any new measure to tackle the illegal immigration problem. NOT. I think we all know why they like to deflect the argument and bait people. They have an agenda and deserve to be ignored.

Here is the text from the petition:

Please use your authority to deploy the military to help protect our nation’s borders. I am extremely concerned about the porosity of both our northern and southern borders. Creating the new Department of Homeland Security is a good initiative, but it will take time. In the meantime, putting troops on the border is an immediate step that will go a long way toward securing our border.

As you know, the Posse Comitatus Act allows the Executive Branch to deploy the military to provide support services such as surveillance, transportation, equipment and air patrols in enforcing federal laws along the border. In fact, under current law, members of our military could assist the Border Patrol in doing everything but performing searches, seizures, and arrests.

I urge you to use this authority immediately to bolster our border security. I hope you will strongly consider adding this important new tool to our nation’s arsenal.
