October 15, 2001 -- PORTLAND, Maine - Isanu Dyson, a fifth-generation American who converted to Islam three years ago, is prepared to join the jihad against the United States, and believes government workers are fair targets. The 24-year-old Maine resident, who carries a dagger and 3-foot sword, told The Post it would be "noble" to enlist with the Taliban and fight against American soldiers in Afghanistan.

But OK now, so are there any statements which would not be protected by the First Amendment? A study of the Federalist Papers and other documents reveals that the speech that the founders were protecting was primarily political speech. This qualifies. I'm not a legal expert so I cannot say exactly what other speech qualifies. It has been ruled in the past by the SCOTUS that certain other speech (such as the sophmoric "yelling fire" senario) are not speech for purposes of constitutionality.
And what if anything can, should be considered treason?
That is a good question for legal scholars, not me. I will opine that it should be looked at in this case and if found to be treason by the courts he should suffer the consequences. My guess is that it would not be found to be that for several reasons.
The commonsense test probably leads to the conclusion that this guy is wacko and would be found insane in any case so the whole thing is most likely a moot point.

naturalized citizen, he swore to defend and protect the United States (not Islam) from all enemies, foreign and domestic..with no mental reservation...among other things.
Wouldn't this be grounds for stripping him of his U.S. citizenship, and deporting him? He swore an oath of allegiance falsely.

These are interesting issues to ponder. Nevertheless, I think that we as a culture have gotten so enmeshed in the petty pseudo legalistic thinking that all too often we are unable to tell the forest from the trees. Every barstool occupant is now a legal expert. Recall the 'innocent until proven guilty' choir right here around the Condidit case.
You speak of common sense, but isn't it common sense to observe that this clown is issuing threats against this country, against the armed forces of this country and otherwise threatening to commit treasonous activities? Do we need some county judge or the ACLU or a television pundit to tell us that it is so or to deny what we can plainly see with our own eyes (more likely)?
As far as insanity, it just doesn't wash, unless you consider anyone committing a crime insane (which some so called "experts" actually do.)
