JUNEAU, Alaska (AP) — A federal judge on Sunday dismissed a Justice Department lawsuit seeking to block certification of Alaska’s U.S. Senate race if Republican incumbent Dan Sullivan loses, the latest development in a ballot controversy that has roiled the final days of one of the nation’s most closely watched races.
Sullivan, an ally of President Donald Trump, faces Democrat Mary Peltola, a former congresswoman, in a race that is among a handful expected to determine which party controls the Senate for the final two year’s of Trump’s term.
Tuesday’s ranked-choice election also includes two candidates who have done little campaigning, one of whom shares the incumbent’s name. It was that candidate’s presence on the ballot that prompted Trump to push for the lawsuit out of fear he would siphon votes from the incumbent.
Shortly after the ruling, the Justice Department filed a notice saying it was appealing: “Alaskan voters deserve a fair election, not to be misled in an attempt to rig outcomes,” a department spokesperson said in a statement.
The lawsuit, filed less than two weeks before the election and as early voting was underway, called for an investigation into whether votes for retired teacher Dan J. Sullivan were intended for the senator. The state said the case lacked merit and argued there would be no way to determine that without violating voter privacy.
U.S. District Court Judge Sharon Gleason wrote in the order that the relief the federal government seeks is “infeasible” because many voters have already cast their ballots.
“More fundamentally, the United States provides no workable plan as to how it proposes to segregate ballots cast for Daniel J. Sullivan on Election Day and then conduct a court-ordered unspecified ‘investigation’ of those ballots in a manner that would preserve voter secrecy,” she wrote.

I’m shocked
let’s overturn this clown judge.
Accomplice. SWAT raid him late on election night. And hope he blinks or does something else to resist arrest.
I hope I’m on the jury if vigilantes decide to nullify these judges cuz jury nullification is a thing regardless of instructions.
U.S. District Judge Sharon L. Gleason is the Chief Judge for the U.S. District Court for the District of Alaska.
Key Background
• Appointment: Nominated by President Barack Obama in 2011, confirmed later that year, and took office in January 2012. She became Chief Judge in January 2022.
• History: She is the first female federal judge to serve in Alaska.
• Education: B.A. from Washington University in St. Louis (1979) and J.D. from the UC Davis School of Law (1983).
Recent Rulings
• Alaska Senate Race Lawsuit (November 2026): Judge Gleason dismissed a Department of Justice (DOJ) lawsuit—brought during the election—that sought to block or delay certification of Alaska’s U.S. Senate race or segregate ballots. The DOJ claimed voter confusion might stem from similarly named candidates (including independent Daniel J. Sullivan and Republican incumbent Dan Sullivan). Gleason ruled that the federal government lacked standing to bring the suit and that segregating the ballots would violate Alaskans’ right to a secret ballot.
• Notable Past Decisions:
• Blocked the Trump administration’s attempt to open the Chukchi Sea to drilling and the Izembek Refuge road in 2019.
• Vacated Willow project permits in 2021 before later upholding the Biden administration’s approval of the project in 2023.
• Fined Greenpeace in 2015 for blocking Shell drilling vessels.
Most honest election in world history.

Having read it i don’t see what else the judge could have done.
The tendency of courts at every level is to avoid getting drawn into election contests on any rationale or pretext possible, even absurdly thin ones. This makes election contests usually fruitless even when gross dishonesty is shown and was large enough to have corrupted the process and result.
The benefit for the DOJ is that this ruling establishes for the purposes of the Alaska Senate election that there was no pre-election federal legal remedy available against the Democratic chicanery. That being established, courts cannot later deny relief on the basis that there was such a remedy that should have been pursued.
Most likely, the courts will still decline to overturn the election if Peltola wins. That would leave it up to the Senate to take up the issue when it comes time to seat her. Plausibly, a GOP majority could reject Peltola and require a new straight up election between her and the real Dan Sullivan. With the rotten conduct of Peltola and her campaign on full public display, Dan Sullivan would have the advantage.
What a conniving distractive strawman the judge has put forth! Imagine an investigation approach that is destined to fail, and because it would fail, imply that all investigation outcomes are hopeless and would necessarily fail!
It turns out Peltola was very much involved in getting the replacement Sullivan to run. Then she lied to Congress saying she wasn't! One of the most ever-present, most partisan political dirty tricksters, Marc Elias, was also directly involved, and on the funding side, Soros' Open Society Foundation has been involved, possibly involving illegality.
I think by the time the DOJ investigation has been fully conducted, multiple criminal charges will have been cited by one or more grand juries.
Follow the money to see what has been delivered to that judge!
annoying meddling district judge, at least this nut is an American, sort of.
Given that you have a strong opinion regarding the Judge’s decision, how do you, in your own words, overcome the issue of standing that served as the basis for the decision? In particular:
1. Redressability, where the Administration failed to offer any meaningful, substantive, and legally supported arguments. Rather, the Administration only proffered one unsupported declarative sentence.
2. The fact that the Administration’s Amended Complaint failed to include the requisite request for relief, which is integral to a complaint.
3. How do you overcome the Purcell principle, under which the Supreme Court held that lower courts should not alter election rules on the eve of an election?
4. How do you segregate the ballots, and more importantly, how do you determine which voters selected the non-incumbent candidate without violating the anonymity of the voters?
5. The Administration also failed to file the requisite request for leave to amend, which cut off its ability to challenge the Court’s dismissal. How does anyone with even a modicum of legal knowledge fail to make this request?
“How do you segregate the ballots…?
By party and then challenge each democrat vote with an Executive Order.
“Plausibly, a GOP majority could reject Peltola and require a new straight up election between her and the real Dan Sullivan.”
I would love but be surprised to see a GOP majority actually do that.
Kaye Ballard’s cousin.
Another low I.Q. Dip**** Court skanky broad “judge” screwing over the American people. Friggin’ maggot
I do not believe Alaska requires voters to declare a party affiliation to vote. Also, how you vote is private...are you suggesting we no longer have privacy rights re voting?
Filth of a judge. Filth of a party
