The Supreme Court on Monday rejected President Donald Trump ’s mail ballot restrictions for now, capping a flurry of last-minute legal action with voting in the midterm elections already underway.
The decision allows states to continue sending out mail ballots under the same processes they’ve used for years.
Justices Samuel Alito and Clarence Thomas dissented from the brief order. Justice Brett Kavanaugh agreed that the restrictions should not go into effect for the midterms but indicated he might rule in favor of the Trump administration later.
The Trump administration had asked the court, once again at the center of a roiling political controversy, to clear the way for restrictions before the pivotal November contests for control of Congress.
The case has major implications because nearly one-third of the country votes by mail.
Election officials have said there was simply no way to carry out a complete overhaul in the weeks before the midterms. Indeed, Alabama, North Carolina and Wisconsin began sending mail ballots to voters over the past week while the new system was still not active.
The Trump administration plan would require states to adopt a uniform envelope style and submit lists of eligible voters to an online portal. The Postal Service could refuse to deliver ballots to states that didn’t comply.
A whistleblower report, though, said the postal system’s requirements could lead to millions of mail ballots never being sent, because the portal wasn’t properly built and a single bar code error could result in an entire batch of ballots being tossed out.

The Court says the government is unlikely to succeed in overturning Talwani’s injunction and the equities do not favor a stay. Kavanaugh concurs but says USPS may have authority to issue the rule; he finds implementing it this close to the election unlawfully rushed.
The ruling leaves Talwani’s injunction in place while the First Circuit considers the appeal. But Kavanaugh’s concurrence suggests the rules could ultimately survive for future elections even if they cannot be implemented for 2026.
Alito, joined by Thomas, dissents. He says the organizations likely lack standing and the states’ ultra vires claim is a “Hail Mary pass” unlikely to succeed because USPS has broad statutory authority to regulate how mail is handled.

If only we still had David Souter on the court, the decision would have been ... never mind. It would have still been 7-2. At least we still have John Roberts there to vote with the conservatives. Oh wait... never mind.
Hard to blame Trump for them. The conservatives all said they wouldn’t vote for Trump so he used an “approved “ list and everyone was so happy about that list. I think Trump should have just done gut picks and not vetted by RINO picks. All anyone cared about for SCOTUS in Trump 1 was Roe v Wade. Well you got exactly what you asked for. Anyone saying otherwise is more likely than not lying.
Still haven’t forgiven the supreme court for saying Paxton’s 2020 election lawsuit against swing states for nullifying our
votes didn’t have standing.
It’s basically Trump against everyone else and I hate them all for it. It’s only freedom, justice and the American way on the line after all...

If Trump didn’t declare an emergency and set aside The Steal in 2020, when he had legitimate grounds to do so, he sure ain’t gonna take any pro-active actions now.
