President Donald Trump responded to Tuesday’s Supreme Court’s ruling striking down his birthright citizenship executive order by appearing to back immigration legislation that would further clarify how immigrants can become citizens.
In a 6-3 ruling, justices held that an executive order Trump issued on the first day of his second term violated the Constitution. The order greatly restricted the circumstances in which a baby born in the United States would automatically be granted American citizenship.
The Fourteenth Amendment states, in part, “All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.”
Chief Justice John Roberts, writing for the majority, concluded, “Children born in the United States to parents unlawfully or temporarily present are ‘subject to the jurisdiction’ of the United States and are citizens at birth under the Fourteenth Amendment’s Citizenship Clause.”
After the ruling, the president used the Truth Social social media platform to post a link to an article from the Washington-based website Just the News that was headlined: “Trump’s efforts to reverse birthright citizenship may succeed with or without SCOTUS.”
He followed up with a second post, writing, “The Supreme Court upheld Birthright Citizenship, which is too bad for our Country, but we can easily make it up in Congress through Legislation, with the support of the President, that has now been determined during this process.”
“No long and unwieldy Constitutional Amendment is necessary! Congress should start TODAY to work on ending expensive and unfair to our Country, Birthright Citizenship. They will have my Complete and Total Support!” he added.

Several ways forward here given the choice of Roberts/Barrett to nullify the 14th Amendment and extra-constitutionally replace it with their own language:
1) Nullification. States issue birth certificates, and they can just stop issuing them to non-citizens. Roberts/Barrett can deal with the fallout and litigate each birth individually.
2) Pack the court. If Robert [sic] wants to be a politician who writes laws instead of a judge, then he can fight with 10 more unelected legislators in robes.
3) Deny entry to all pregnant foreigners.
4) Deny entry to all female foreigners.
5) Require sterilization of all foreign visitors prior to entry.
6) Dissolution of the Union. A nation which can’t even restrict who gets to be a citizen isn’t a nation.
7) Amend the Constitution. This is pointless, because once a judge decides he can rewrite the Constitution at will (as Roberts and Barrett did today), the actual text is meaningless. But this is what most GOP politicians gravitate towards because they are useless.
If you think all these options are not great, understand that that is what happens when unelected judges decide that they are in charge of the country and get to write its laws.

The majority decision was all of the female justices with the traitor Roberts. Kavanaugh concurred with the result.
I’ve read elsewhere that the USSC decision was 5-4 with Justice Kavanaugh voting against but issuing a statement agreeing with the 5 in the majority as to ‘constitutionality’ but suggesting that he voted against because it was a ‘statutory matter’ for Congress to decide.

I believe Kavenaugh didn't agree with the five on constitutionality.
He only claimed that Trump EO was invalid because there was an existing statute.
