The Supreme Court on Monday ruled that states can continue counting mail-in ballots sent by, and received within, five days of Election Day - delivering a staggering blow to President Donald Trump on one of his biggest fixations.
The high court ruled 5-4 to allow state voting laws that permit the counting of the mail-in ballots to remain in place. Republicans argued it conflicted with federal legislation.
'The federal election-day statutes do not prevent Mississippi from counting absentee ballots postmarked by election day but received up to five days thereafter; nothing in the federal election-day statutes requires ballots to be received by election day,' Justice Amy Coney Barrett said, writing for the majority. .

Mail-in ballots have long been an obsession of Trump, who blamed them for his 2020 defeat to Joe Biden. He repeatedly harped on this claim despite studies showing minuscule amounts of fraud occur with mail-in voting. [***cough, cough***]
Nonetheless, Trump pledged to lead a 'movement to get rid of mail-in ballots' and even signed a sweeping executive order earlier this year directing the government to create a list of 'approved' mail voters.
A federal judge struck down that order.
In her opinion, Barrett argued that the Constitution purposefully left election rules flexible, knowing the country would change over time. With an election day was written into law, the 'election day statutes say nothing about ballot receipt,' she wrote.
'We cannot add to the words Congress chose,' Barrett continued. *** Justice Samuel Alito cited concerns that 'confidence in election outcomes can be seriously undermined' when results of elections are delayed. Justice Brett Kavanaugh echoed this, noting that 'if the apparent winner the morning after the election ends up losing due to late arriving ballots, charges of a rigged election could explode.'***

Yes, Congress needs to pass a comprehensive election law.
Namely, that no electors will be accepted for results reported after 12:00am on the day after Election Day. Nor will any representatives be seated which don’t comply with this requirement.

They didn't anticipate anybody voting by mail, much less having the ballot arrive AFTER the election and the counting to continue days AFTER the election.
They all knew and understood Election Day meant what it says...DAY. If only they had been clairvoyant.
Obssession
Trump needs a law, his executive writ is empty without a supporting law or Supreme Court precedent. The Constitution alone does not give the executive, acting alone. powers over federal elections.
This isn’t a death knell because it doesn’t say they can count ballots WITHOUT a postmark, and there’s a federal law against forging a postmark (in this case “stamp” refers to the device used to apply a postmark):
18 U.S. Code § 503 - Postmarking stamps
Whoever forges or counterfeits any postmarking stamp, or impression thereof with intent to make it appear that such impression is a genuine postmark, or makes or knowingly uses or sells, or possesses with intent to use or sell, any forged or counterfeited postmarking stamp, die, plate, or engraving, or such impression thereof, shall be fined under this title or imprisoned not more than five years, or both.

Amy for all her high position being on the court, doesn’t seem to understand what the word “day” means. To begin with it’s singular, not plural. That indicates one day, not run on days.
