Mayes will go back to the grand jury after Arizona Supreme Court doesn’t revive fake electors case

The Arizona Supreme Court has refused to revive the case against the state’s 11 fake electors who tried to help President Donald Trump overturn his 2020 loss, leaving its outcome at the mercy of the midterm elections.

Last year, Arizona Attorney General Kris Mayes asked the state’s high court to reverse a trial court’s ruling that froze the case. Two years ago, an Arizona grand jury indicted 18 people who signed a document claiming to grant Arizona’s electoral votes to Trump on state fraud charges, including top Trump allies Rudy Giuliani and Mark Meadows.

Also indicted were state Sen. Jake Hoffman, former state Sen. Anthony Kern, Tyler Bowyer, the COO of Turning Point Action and Kelli Ward, who at the time of the effort to undermine Biden’s win was the chair of the Arizona Republican Party.

Attorneys for the fake electors told a trial court that the indictments were invalid because prosecutors didn’t give jurors a copy of the 1887 Electoral Count Act, which they said absolved them of any wrongdoing. The 138-year-old law sets up how to count electoral votes and includes a legal framework for Congress to resolve disputes that arise when a state sends multiple slates of electors. Maricopa County Superior Court Judge Sam Myers agreed with the defendants, sending the indictment back to the grand jury and effectively killing the case.

As a result, Mayes will return to the grand jury to try and restart the prosecution, a spokesman said. But whether any indictment is ultimately prosecuted hinges on whether Mayes, a Democrat, wins reelection in November. The Republicans who hope to defeat her are unlikely to take up the case.

I was a “fake elector” in Maryland. Actually we are the alternate or contingent slate that exists in case our candidate wins a challenge.

What the heck is a “fake elector” anyway? I’ve heard this term but what is the actual crime they stand accused of? They didn’t cast any votes or anything so what gives? Just seems like a made up charge “I’m citing you because your ramistan doesn’t intersect approximately at the paramus”.

I don’t understand what a “fake elector” is, or even what it could be.

I suppose if you forged a Certificate of Ascertainment and forged the Governor’s signature, and mailed it to the Secretary of State - that’s probably a crime.

But that’s not what is happening here, right?

Correct That is not what is happening. The Left wants to punish us for believing we might have won. It’s a thought crime at best. There is no forgery until a document is presented as something it is not.

It's a false clai, and one that Democrats have even sent alternative electors in the past. We saw them from Hawaii during the JFK election:

In the 1960 presidential election, Hawaii sent two competing slates of electors to Congress due to an unresolved recount: one Republican slate certified for Nixon and one unofficial Democratic slate for Kennedy. After a court-ordered recount confirmed Kennedy won by 115 votes, the Democratic electors were officially certified, and Vice President Richard Nixon, presiding over the Senate count, accepted their votes without objection.

The election was not settled, but the deadline for elector college to vote was there.
So the republican electors voted for Trump, just in case.
For that “crime” they are being viciously prosecuted, labeled “deniers” and some kind of terrorists trying to destroy US democracy!

For some reason, the elector stories here always seem to leave out the forged documents.
