Lynchburgh, Virginia Circuit Court Judge F. Patrick Yeatts has sided with Gun Owners of America and Virginia Citizens Defense League and rejected the attempt by Gov. Abigail Spanberger and Attorney General Jay Jones to resume requiring background checks on the private transfers of firearms.
In a ruling delivered from the bench after a hearing on Thursday, Yeatts declared that his previously-issued injunction on Virginia's universal background check scheme is still intact, despite Democrats' efforts to do an end-run around the injunction.
[.....] Yeatts has been dealing with this issue for several years now, and has previously ruled that adults under the age of 21 have the right to possess a handgun. Under newly passed HB 1525, though, that right has been stripped from them in an attempt to impose a NICS check on all private transfers. Any NICS check on a handgun purchase is going to be flagged by the system given the federal prohibition on commercial handgun sales to under-21s, and the state of Virginia had previously tried to get around that by running checks on private sales of handguns to young adults through a system administered by the Virginia State Police.

Attorney General Jay Jones has been quiet on today's defeat, at least so far, but expect him to appeal the judge's decision in short order. Once this case reaches the appellate court, I have no idea what will happen, but there are a number of issues at play, including whether or not Virginians under the age of 21 can be prohibited from purchasing firearms given their status as full, legal adults under the state constitution. The legal fight is far from over, but VCDL and GOA won a major battle in court today, while Spanberger and Jones are the big losers.

This had nothing to do with keeping guns out of the hands of bad guys and everything to do with collecting info on gun owners in general.
Please bring this judge to Colorado...
Regulations are still maddening.
I took my AR to a gunsmith to do some site work and he said he had to record the gun with the feds. I was not purchasing anything gun-related, but I was reported anyway.
It's going to be an uphill battle though, Virginia already denies anyone under 21 to purchase alcohol or tobacco products, and according to this logic that would apply to them also.

Ohio here, and I’ve taken mine to a gunsmith because of an issue with ejection and feeding. Small variations on parts or magazines can sometimes cause issues. Whole there is some stuff I can do myself, I don’t really have the equipment/workspace to do a professional job.

....agree....! here in Texas, at any gun show, you will find numbers of private sellers...they are not “in the business”
of selling and buying firearms, but just citizens who have
firearms to sell....all you need to purchase a firearm from
a private seller is proof of Texas residency...requiring
background checks on private sales would require the sellers
to provide paper or very less likely the Fed form 4473 in
electronic form for the buyer to have to complete....this is nutz...!!!

Earlier this year the Lynchburg court struck the UBGCs down, but a couple of weeks ago the RATs in Richmond (back in full power) tried to put them back in affect, but GOA and VCDL rose to the occasion again, and got them struck down and slapped the governor and the AG down.
If it wasn't for the GOA and VCDL, we'd be Kalifornia East.
I agree completely, but I’m looking at exactly what their attorneys are going to point to now.
I’ll take it as a win, for sure… But the real victory comes when we don’t need a judge to tell these bastards to lay off our rights. The real victory comes when these scumbag politicians are terrified of the people that they are supposed to be representing.
The real victory comes when they’re saying people tell those politicians “GF yourself” followed by “come and take them “.
The judge is a speed bump. These bastards won’t stop until they’re made to stop.

Yep - it was an attempt at a gun registry, so if they felt powerful enough, they could use their jackboots to kick down doors.
