A Utah man missed his connection at Newark Airport, went to retrieve his checked luggage, which contained a properly declared, unloaded firearm, and got arrested. He did everything right. New Jersey didn't care.
The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) cited that case in a proposed rule published earlier this week that would amend existing Gun Control Act regulations to protect gun owners during routine travel interruptions — a missed flight, a hotel stay, a fuel stop, a medical emergency.
The Utah case isn't an outlier. New York and New Jersey have made a prosecution racket out of ensnaring travelers passing through their airports and highways with legally owned firearms. A flight delay, a missed connection, an honest interaction with airline staff — and a law-abiding gun owner is facing felony charges. New Jersey has charged tourists who declared firearms at baggage claim — Shaneen Allen, a Pennsylvania mother with a valid carry permit, disclosed her firearm during a traffic stop and faced three to five years in prison. New York has arrested travelers whose flights were diverted, who never intended to set foot in the state — Ryan Jerome, an Indiana businessman with a valid permit, tried to check his firearm at the Empire State Building and was held for 48 hours on felony charges. In both cases, the local DA's office knew exactly what it was doing. The law was a tool, and the target was someone who made the mistake of passing through with a firearm they had every right to own.

I don't want to pass through or fly over NJ, armed or unarmed. The states should be under permanent quarantine to protect the rest of the nation.

I refuse to vacation in any state that will not allow me to carry my firearm. I am to damn old to fight a young thug. I would loose. I am adept with a firearm for over 60 years of shooting. I have never used a weapon in an illegal manner and own many. I am a shooter of paper targets, a collector and ex hunter. I just got tired of killing animals. I have no problem with ethical hunters and one hunts my land. We share the venison. It is delicious.
An ethical hunter obeys the game laws. An ethical hunter always has safety in mind. An ethical hunter does not take the shot unless he thinks it is a sure kill. Sometimes errors happen, and he is then obligated to track down the animal and kill it mercifully. Here in Texas the Texas Game and Wildlife Commission are our best friends. We all want the same which is the maximum sustainable healthy population of game animals. We hate poachers. Our wildlife commission does a great job.
All of these unconstitutional abuses are grounds for a Second War Between the States. New York and New Jersey (and other states, like CA and WA) refuse to abide by the Second Amendment. They don’t care what the U.S. Supreme Court rules. They don’t abide by ATF rules with which they disagree. The only thing the ruthless tyrants understand is all-out, large-scale force until TOTAL patriot victory is achieved. I do not see how a second American civil war can be avoided.
>> I don’t want to pass through or fly over NJ, armed or unarmed.
You’re adventurous! I don’t plan to go east of the Red River. ;-)
>> An ethical hunter obeys the game laws.
You’re not from Louisiana, are you? :-)
From Florida I get to New Hampshire by way of Scranton...
I believe, there is a federal law, that allows anybody to travel through any state with unloaded and stored gun, if it is lawful to poses it on both ends of the route?
Somebody correct me?
I bought a car in CT near Hartford some years ago. I drove it home to ATL via Scranton.
Firearms owners protection act.
Doesn’t allow for stops.
Like the Constitution ever made a difference to the tyrants in blue states.
You did not comprehend the article.
Yes, if you are just making a connection through Newark, NJ airport, there are no problems. But if you miss your connection due to weather or equipment problems, then you must go and retrieve your bags. Now you are in possession of a firearm in New Jersey, which is against their law and they love to prosecute those unfortunate travelers.
It is government harassment of lawful firearm owners.
That needs to be stopped.
Obviously the court system is cashing in on citizens just as they do on DUI/DWI ....what makes this even more egregious is these poor people don’t reside in the area and I’m POSITIVE they are offered a “buyout” option to make it all go away. Think about it, individual has the means to travel and abides by all of the firearm laws while enroute and they get arrested/property seized/incarcerated/need legal (hahahahaha) representation and probably are not indigent so they have to purchase local lawyer...CHA-CHING! A predictive thought out scam enforced ONLY for obtaining money. This is not something any Police officer wants to do, it comes from the grifting thieving law makers that sit in their state houses.
Those States should be severely fined for practicing law-fare.
Your comment is quite similar to my situation. I own several weapons and target practice regularly. I typically travel concealed.
N.J., for a small state has a lot to offer. Problem is the damn democrats that are running the state into the ground, always following in the footsteps of N.Y. Taxes, regulations up the wazoo, crime, illegal aliens, etc. Both states have some beautiful places, but you have to pay through the nose for everything. You have to pay to access the beach, parking, can’t eat or drink or smoke on some beaches it sucks. The western hills are better, but getting crowded too. I would have no problems leaving, but I would have to divorce my wife of 52 years and that would be even more expensive. Well, that’s life.
I’ve never flown with a gun. This is why.
Illinois is an anti gun, anti self defense state. We’ve traveled through it a few times with our guns locked up in an area where the driver cannot access them as well as being unloaded. This is the supposed law travelers must follow.
Think of how stupid that is. In a self defense situation in that state a traveler would be dead.
My understanding of the law is we cannot spend the night there either while transporting weapons. If we ever make another trip again I will have an extra fuel tank and carry food and drink with us to cross the whole damn state. The only stops would be rest areas.
