A federal appeals court Wednesday shot down President Donald Trump's request to rehear his appeal of the $83 million defamation case brought by writer E. Jean Carroll
In a split vote, a majority of the 12-member 2nd U.S. Circuit Court of Appeals denied Trump’s motion for a hearing by the full bench of judges, or an “en banc” hearing.
The decision opens the way for Trump to ask the Supreme Court to hear his argument of presidential immunity.
A federal jury decided in 2024 that Trump defamed Carroll when he disputed her accusation that he sexually abused her in a dressing room in the 1990s.
A three-judge panel of the 2nd Circuit first rejected an appeal from Trump based on presidential immunity in September.
In his second appeal, Trump's lawyers sought to replace the defendant with the United States and make another claim of presidential immunity, which the appeals court dismissed Wednesday.
"The fact of the matter is that no other defendant would be permitted to move to substitute the United States in his place, fifteen months after trial and the entry of judgment against him," Judge Denny Chin wrote in a 34-page statement supporting the court's decision. "The Court appropriately declined to convene en banc to revisit this issue."

It is a very high standard for a federal court to overturn a verdict under state law.
this is literally the stupidest court case that’s ever existed in the history of court. That woman is a nutcase.
The award is a travesty of justice.
if it was aginst a democrat president it would have never made it to trail.
Anti defamation laws shouldn’t exist. They violate free speech.
This case more than almost any other shows that blind justice is completely dead and that the court system is completely rigged to get the outcomes the “powerful” want.

The whole episode is an absolute farce.
The evidence she submitted that she “was associated with” Trump was a photo of her and her husband at party, 8 years before the alleged rape, in a public receiving line with large group of people together with Trump, while his back is turned!
She couldn’t even remember the year of the alleged rape. She claimed it all happened within 3 minutes. She claimed she was wearing a dress which wasn’t on the market until 10 years later. Even the rigged NYC jury said it was impossible to prove any rape occurred.
So the judge and DA “allowed” a ridiculous “defamation” case instead.
That case was a travesty in numerous legal and procedural ways. She took it straight from a TV show. She couldn’t even remember the year? And I still say that in the 1990s, if Trump walked into a luxury store in NYC, there is no freaking way he wasn’t watched like a hawk just for over the top customer service reasons.
There is no way he went into a women’s fitting room and raped a woman. And face it, with his fame and money back then, he had easy top-shelf ass available ON DEMAND. She woulda been the last on his list.
This is a travesty legally.

So let me see if I have this straight:
Crazy woman makes rape allegation, has no evidence, never reported it until 30 years later, has no contemporaneous anything to back it up, can’t even remember the date or even the YEAR when it allegedly happened. Man accused says it never happened, and that she’s full of sh*t, and HE gets charged with defamation?!
Make it make sense.
Don’t pay, ignore the judge’s contempt order, take it up to the Supremes and win there. Years and years from now, this woman will die before she sees a dime.
I recall something about the dress she said she wore that day hadn’t even been designed yet.
What the Biden junta did was unforgivable. They acted just like the tyrants pictured above. The courts need to erase this stain upon American history but I'm not holding my breath. The same scumbags that railroaded the J6 defendants into the DC Gulag are still there fat dumb and happy.
