In a letter, AG Kris Mayes and SOS Adrian Fontes warned that election officials who improperly release protected voter information could face criminal consequences
Arizona Attorney General Kris Mayes and Secretary of State Adrian Fontes have sent letters to county recorders urging them not to comply with federal requests for voter data tied to new investigations into the 2020 election.
The letters were sent as federal authorities, including the FBI and the Department of Homeland Security, pursue probes related to the 2020 presidential election in Arizona.
In the joint correspondence to county officials, Mayes and Fontes warned that providing certain voter information to federal investigators could violate state and federal law.
They urged county officials to refuse any requests for full voter registration files containing personal identifying information.
“I implore you to fulfill your oath by declining any such illegal demands,” the officials wrote in the letter to county recorders. The letter also warns that election officials who improperly release protected voter information could face criminal consequences. Mayes and Fontes wrote that “the failure of any election official to follow Title 16’s requirement is also a class 6 felony offense.”

The willingness of Mayes to prosecute election officials was demonstrated in 2023 when former Cochise County supervisors Peggy Judd and Tom Crosby were criminally charged with one count each of conspiracy and interference with an election officer after they delayed the canvass of votes cast in Cochise County in the November 2022 General Election.
The warning came shortly after Arizona Senate President Warren Petersen announced that the Senate had complied with a federal grand jury subpoena seeking records related to the legislature’s review of the 2020 election in Maricopa County.
“The FBI has the records,” Petersen wrote on social media after turning over documents connected to the controversial 2021 audit of the county’s ballots, as reported by The Atlantic.
That audit, conducted after the 2020 election, ultimately reaffirmed President Joe Biden’s victory in Arizona, though it became a flashpoint in national disputes over election security and claims of voter fraud.
Federal investigators are reportedly seeking records tied to voter registration systems and election administration following the 2020 election. Earlier this month, the California Globe reported the FBI and Department of Homeland Security have opened probes related to Arizona’s election results, while a federal grand jury subpoena sought records connected to the Arizona Senate’s review of the 2020 election in Maricopa County.
Mayes and Fontes argue that certain voter records, including data such as birthdates, Social Security numbers, and driver’s license information, are protected under law and should not be provided to federal agencies without proper legal authority.
The officials indicated that their offices would consider legal action if necessary to prevent the release of protected voter information.
“Our offices are committed to upholding the sanctity of Arizona’s elections and democratic process,” the letter states. They added, “We will pursue to the fullest extent of the law all possible remedies to ensure the integrity of Arizona’s elections and the privacy rights of its citizens.”
The letter was also issued amid an ongoing legal dispute between the Arizona Secretary of State’s Office and the U.S. Department of Justice over requests for detailed voter registration information.
The federal probes are part of a broader effort by the Trump administration to investigate allegations related to election integrity. Arizona has become a focal point of those investigations due to the state’s narrow presidential election margin and the controversy surrounding the Maricopa County audit.
Mayes and Fontes said their offices will continue to monitor the situation and coordinate with county officials on any federal requests for election records.

Subpoenas are for business records, not criminal evidence. The states should require what the 4th Amendment specifies - a Search Warrant issued upon a showing of probable cause that a crime has been committed, and the specifics of what the search is seeking.
Invoking your Constitutional rights is always appropriate in our country, unless we’re willing to take them away from everyone.

I believe interfering with the operation of a legally issued federal subpoena constitutes obstruction of justice, or some related offense.
And since the obligation to comply with federal law is, under the Constitution’s supremacy clause, an obligation that overrides contrary state law, the state laws they cite are no defense.
So arrest these mofos and let them sit in jail for a while.

If the Feds made a valid request, as law applies, and still haven’t supplied the files, LOCK THEM OUT OF CONGRESS!! And stop paying them. Tell them to come back when you’ve passed election audits.
