A federal judge has declared a mistrial in the high‑profile case accusing nine North Texans of attacking the Prairieland ICE Detention Center on the Fourth of July, after determining that a defense attorney’s shirt could improperly influence potential jurors.
The mistrial was issued Tuesday during jury selection, after Judge Mark Pittman noticed that defendant Maricela Rueda's defense attorney, MarQuetta Clayton, was wearing a T‑shirt under her jacket with images tied to the civil rights era beneath her jacket.
Clayton later exited the courthouse with the shirt turned inside out, which had depicted images of Dr. Martin Luther King Jr., Shirley Chisholm, and other civil rights leaders. It appeared the attorney was wearing it in honor of civil rights leader, Rev. Jesse Jackson, who died on Tuesday, as well as Black History Month in February. Clayton did not confirm the reason for the shirt verbally to reporters.
But in court, the judge said the graphics could be interpreted as political messaging and risked biasing the jury.
Clayton declined to speak to NBC 5 outside the courthouse after the mistrial was declared and the courtroom was dismissed.
Legal experts say the move is highly unusual. While the mistrial is unprecedented, they said declaring it before a jury was seated eliminates any double‑jeopardy concerns.

I hope that she has to pay all of the additional court costs.
This was a clear case of Antifa attacking federal ICE agents.
She should have been fined.
Marquetta proudly states that she has raised two children alone as a single mother. Was it really alone? No government assistance?

If I was a defendant, I’d be pissed that my trial was delayed. On the other hand, if I was a defendant and had this lady for my lawyer, I would pretty much be an idiot. So, there’s that.
