Supreme Court Justices must be smart, wise, and steadfast, too, especially when under pressure. Alito checks all of the boxes and more.
Tomorrow, January 31st, will mark two decades since Justice Samuel A. Alito Jr. was confirmed to the U.S. Supreme Court. I was a law student that day and had spent much of December 2005 working early mornings and late nights with other interns at the Department of Justice to assist with his nomination. At that time, his confirmation was one of the highlights of my professional life. Twenty years later, it still is.
I first heard about Justice Alito from one of my professors. The hunt for clerkships is competitive and stressful, and I was looking for guidance on how to navigate the process. My professor’s eyes lit up when he mentioned Alito; evidently, they had worked together, and my professor told me about Alito’s combination of horsepower and good-naturedness. I knew right then that I wanted to clerk for Alito.
That didn't happen at first, which turned out to be for the best. Alito was nominated and confirmed to the Supreme Court before I graduated from law school. Instead, I was able to clerk for two wonderful judges who changed my life: Judge Jerry Smith on the U.S. Court of Appeals for the Fifth Circuit and (now retired) Judge Janice Rogers Brown on the U.S. Court of Appeals for the D.C. Circuit. Had I not clerked for Judge Smith in Houston, I doubt very much that I would have ended up many years later as Texas Solicitor General. I don’t think it’s any exaggeration to say that Samuel Alito is the best thing George W Bush ever did .
Alito has the highest conservative-leaning Martin-Quinn score on the court of 2.59, according to 2022-23 data. Thomas was at 2.36.
And Alito is younger.
No Democrat in a million years would have nominated Alito.

Best thing was read the room which was screaming and yelling no Girl Friday for SCOTUS and withdraw the name of former state lottery commissioner Harriet Mears from consideration.
…..and even THEN it took the failed nomination Harriet Miers to replace O’Connor. Miers withdrew her acceptance of the nomination after encountering widespread opposition.
Then we got Alito.
That was one of the peak wtf moments from Dubya’s years

Miers must have been some misguided attempt at payback for Texas political favors. She probably would have been on the Souter spectrum. At best….

Yes, Alito was a stellar pick. We can thank Jeb Bush for Roberts. Reportedly Jeb hounded Dubya to appoint Roberts to the bench because they owed him for helping out legally on the hanging chad stuff during the 2000 election.

It is a bit of an exaggeration. I’ll explain.
George W. Bush almost didn’t nominate Alito. Bush nominated Alito because conservative activists got up off of their couches and actually did something useful. We fought against Harriet Myers, do you remember?
I don’t think it’s any exaggeration to say that Samuel Alito is the best thing conservative activists ever did in the 8 years of George W. Bush’s presidency. We fought the dragon. We won.
Bush doesn’t deserve the credit here, that’s “the why” it is an exaggeration. We forced him to do it. We deserve the credit. Not him.
Yep. So Dubya shouldn’t get all of the credit. He had to nominate Alito, reluctantly.
