Virginia Democrats Pass Abortion Amendment that Will Go Before Voters in November
Breitbart ^ | January 19, 2026 | Katherine Hamilton

Virginia Democrats passed a constitutional amendment on Friday that would codify within the state constitution the right to kill unborn babies in abortions.

The proposed abortion amendment will now go before voters in a statewide referendum in November. The Democrat-controlled state Senate also passed amendments to address same-sex marriage, restoring the voting rights of felons who have completed their sentences, and redistricting, WRIC reported.

In Virginia, constitutional amendments must be approved by both the state House and Senate twice before being placed on a ballot and ratified by a simple majority of voters. State lawmakers passed the first three amendments in January 2025 and passed in late October the redistricting amendment, which would temporarily authorize the legislature to amend state congressional maps if any other state legislature changes its maps between Jan. 1, 2025, and Oct. 31, 2030.

The abortion amendment, sponsored by Democrat state Sen. Jennifer Boysko and Democrat Del. Charniele Herring, would create a “fundamental right to reproductive freedom, including the ability to make and carry out decisions relating to one’s own prenatal care, childbirth, postpartum care, contraception, abortion care, miscarriage management, and fertility care.”

The amendment would allow some regulation of third-trimester abortions but would prohibit the state from banning abortions that a physician deems needed to protect the “life or physical or mental health of a pregnant individual” or if the physician deems the baby “not viable.”

“Republicans opposed the amendment unanimously. Some attempted amendments to preserve parental consent laws or ensure care for babies born alive, but these were rejected by extreme Democrats who want no limits on killing babies before birth,” LifeNews reported.

In Virginia, abortions are currently legal through 27 weeks of pregnancy.

Gosh, it’s all so, all so...historic. /S

“Spanberger was sworn in alongside fellow Democrats Ghazala Hashmi, who took the oath as lieutenant governor, becoming the first Muslim woman to win statewide office anywhere in the United States, and Jay Jones, who was sworn in as Virginia’s attorney general, making history as the commonwealth’s first Black attorney general.”

“It marks a new chapter in Virginia as Democrats pull the levers of power in state government.”

“The focus is on passing the constitutional reproductive rights amendment again in the 2026 General Assembly session to get it before voters in November 2026, potentially making Virginia the first Southern state to constitutionally protect abortion rights, according to the Center for American Women and Politics (CAWP) and the Virginia Mercury.”

Do they mean women? This pretty much means abortion on demand at any time for any reason. Why can’t they be honest and also codify infanticide into the law?

Tell me again how my sex is the gentler sex.

A haiku for the bloodthirsty abortion party and their ilk.

Flesh breaks, heat floods in,
Pulse between the tongue and teeth—
Breath devours the night.

And it will be portrayed as the pro-family vote in ads with laughing children, clergy, warm music with caring grandmothers appearing, etc. like in every other state to make voters think they are voting for a “moderate” policy vs. extreme leftist policy...and it passes overwhelmingly, even if the overwhelming majority of the electorate actually opposes the policy.

Every Blue Zoo will have an abortion referendum on the ballots as a Democrat voter enhancer tool every election. Soon, DNC sponsored credit cards will start offering rebates that can be used for abortion services instead of 2% cash back. If you’ve outlived your fertile years, the 2% cash back can be used for the lefty candidate of your choice.

I hate to say it, but every time abortion is on the ballot the liberal women go into a frenzy and will crawl through glass to vote for it….and many pubbie women too. I don’t know if pubbies have\had any chance in VA, but this move will kill it. I live in MI and Dems swept statewide races when this was on the ballot (2022, I think. I know, I know, I’m Debbie downer but calling it like I see it. It breaks my heart. I hope our VA brothers and sisters fight with everything they have, though.

“Spanberger was sworn in alongside fellow Democrats Ghazala Hashmi, ... and Jay Jones

Spanberger said, "If only we had abortion on demand, we could focus on making sure that all the negro babies were aborted. Then you would not have to face the idea of a state attorney general like Jay Jones!"

Any bill that sanctions abortion is antithetical to the Preamble goal of securing the blessings of liberty to ourselves and our posterity. It ought be rendered null and void from the outset as utterly contrary to the sprit and intent of our founding principles and goals.

“Virginia Democrats passed a constitutional amendment on Friday that would codify within the state constitution the right to kill unborn babies in abortions.”

And that is their privilege to set up their state abortion laws. The feds no longer play the game. That is up to the states and their voters. And it will end up in court sooner or later determining the legality of it and the SCOTUS shouldn’t hear it letting it fall back to a lower court at state level. Federal intervention was taken out of the process.

Of course. That’s not the point. The point is that it will be on every state referendum in every election for the next 20 cycles. They will announce some threat to abortion exists even if that’s not true, but to just maximize their base turnout. It’s to keep devotion to the ballot up and down among the soccer moms and women’s groups. With ballots stacked full of lefty socialists already, how do you “peak excitement” in an election once you’ve filled the ballots with what are truly embarrassing candidates. You threaten a woman’s right to choose, even though no threat exists. You just make stuff up. It doesn’t have to be true. In fact, it’s best if it’s bull crap anyway. It still explodes voter turnout, maximizes fundraising, and maintains name recognition with media coverage.
