Bombshell memos: Biden aides believed he should sign pardons by hand, he outsourced approval to VP

The new internal memos from the Biden White House are the first glimpse into the Trump administration’s probe into the former president’s mental decline and the abundant use of his autopen signature.

Internal memos obtained by Just the News show President Joe Biden’s aides believed at the beginning of his administration that he had an obligation to personally sign official presidential actions, including pardons, and chronicle how the former president later outsourced clemency decisions to then-Vice President Kamala Harris.

The memos were gathered as part of a sweeping review by the Trump White House into Biden's use of autopen signatures for official business, an inquiry that now raises new questions about whether the former president actually attended four meetings late in his term dedicated to making clemency decisions.

Those clemency decisions included pre-emptive pardons for Biden family members as well as commutations for federal death row sentences.

No records of Biden attending meetings that resulted in clemency The National Archives and Records Administration told the Trump White House Counsel's office that "we did not find specific meeting notes that clearly mention or note that the President was present" for any of the four meetings, according to the documents reviewed by Just the News.

"President Biden’s decision memo on commuting federal death row sentences is unmarked, and NARA cannot find a version indicating President Biden’s approval," the documents added.

The Office of Joe and Jill Biden did not respond to a request for comment sent through its contact page.

If a CEO in the private sector did this there would be lengthy prison sentences.

Incompetence in record keeping isn’t a defense.

Oh dear, this could ruffle some feathers. It looks like invalidating those pardons is beginning to look possible. I bet the people who authorized the MaL raid are starting to wish they’d never done that.

This pretty much invalidates the pardons.

The constitutional power to pardon is vested in the President alone.

The presidents pardon power is virtually absolute and there is very little formal pardon process requirements spelled out. In the constitution

However, if the pardons don’t originate from the President all bets are off .

” the Vice President cannot issue federal pardons because that power is Constitutionally vested only in the President. However, if the President becomes temporarily unable to perform their duties, the Vice President can become the Acting President and would then have the authority to pardon the President. “

If Comma-La did it (or anyone else) its illegal/void

if the President becomes temporarily unable to perform their duties, the Vice President can become the Acting President and would then have the authority to pardon the President

If they try to hang their hats on this, it won’t fly. The president has to be declared unable to perform his duties. He was not/did not do so.

it looks more and more like the pardons signed by autopens will be voided.

Biden can not now testify that HE pardoned those people because he doesn’t even know who they are, let alone if he meant to pardon them.

“”””If a CEO in the private sector did this there would be lengthy prison sentences.””””

This is like writing checks and forging the signature on checks that the boss doesn’t know about. Or, mom has dementia and I decided to write a bunch of checks from her account because she will never figure it out.

That was likely Jill’s call. She had to know there would be a problem and distanced Joe from the actual deed

At this point, Biden will claim that he approved everything. But is that sufficient to meet the requirement for presidential approval? Only the President can approve pardons and clemency.

A succinct version of the conclusion:
Moron No. 1 "outsourced" his signature to Moron No. 2 for each of the pardon documents.
(Of course, the term "moron" could be appropriately -- and arguably more accurately -- replaced by the term "retard", as a matter of personal preference.)

"However, if the President becomes temporarily unable to perform their duties, the Vice President can become the Acting President"

That would have had to be done officially, with notification to Congress.

"To temporarily transfer power to the vice president, a president sends a letter to the speaker of the House of Representatives and president pro tempore of the Senate stating he is “unable to discharge the powers and duties of his office.” The vice president then becomes acting president. When the president is ready to resume authority, the president sends another letter. That’s spelled out in the 25th amendment’s Section 3."
