NY appeals court throws out $500M penalty against Trump in Letitia James civil case

An appellate court has thrown out the $500 million civil fraud penalty against former President Donald Trump in the high-profile case brought by New York Attorney General Letitia James....

...The panel upheld findings that Trump and his company were liable, affirming that James acted within her authority and that injunctive relief to curb Trump Organization practices was appropriate.

The ruling leaves liability intact but eliminates the massive financial penalty.

So the court tossed the verdict as excessive, but did find that the theory of liability regarding alleged inflation of property values was valid.

That kind of surprises me. I figured the verdict would get overturned, but I thought it would be on liability as well as excessive damages.

Both sides will appeal this to the New York Court of Appeals.

Hochul will have to come out again and assure New York real estate developers that, again, it only applies to Trump and not to any of them.

The entire case will be dismissed in the end, including the egregious legal theory, if not New York will lose all business.

If he is “liable” so are thousands of other owners and developers over many decades...including James herself.

Maybe they didn’t want to be the ones who threw it all out. Now they can blame another court for doing that. After all, they are still New York libs who have to live with their fellow crazies.

By the judge's theory, if I list my vehicle on craigslist for $20,000 and sell it for $19,000 I have committed the crime of inflating its value.

So the THEORY of liability for inflating property values in a loan process is valid — just irrelevant in a case where neither the State nor the lenders suffered any losses.

So under this valid THEORY, Trump/The Trump Organization is liable for nothing. This was known to the prosecutor before the case was even filed, begging the question of WHY wvs it filed? We all know the answer. The State owes Trump all his legal defense and court costs due to a poliically motivated prosecution, plus damages.
