The Ninth Circuit Court of Appeals on Wednesday said President Trump’s birthright citizenship executive order is unconstitutional.
In a 2-1 ruling, the appeals court upheld a nationwide injunction against Trump’s order.
The three-judge panel included: Majority: Judge Gould (Clinton), Judge Hawkins (Clinton) – Dissent: Judge Bumatay (Trump).
“The district court correctly concluded that the Executive Order’s proposed interpretation, denying citizenship to many persons born in the United States, is unconstitutional. We fully agree,” the majority wrote.

I have a lot of experience with this. My wife is from China and has permanent resident status. According to the paperwork that I signed, I am responsible for taking care of her and her needs. If she commits a serious crime, she can be deported back to China.

First, we need a Supreme Court ruling to stop this crap, which given the intent of the 14th Amendment, it was never intended to grant citizenship to anyone who manages to make it ashore and give birth on a beach. It was meant to address the issue of freed slaves.
But we need to make this change in the form of a Constitutional amendment as well. If we can get more seats, we can get 2/3rds in the House and Senate, I think we can also get 3/4 of the states to approve it, and screw the blue states.
I live under the tyranny of a blue state, and nothing would give me more pleasure than to see those scumbags in my state gnash their teeth.

It sets up a classic originalist/textualist conflict. My guess is that Gorsuch at a minimum would side with the three lefties because he's a textualist.
My guess is it would be 8-1 with Thompson the lone dissenter, or perhaps 9-0. However, there's a good chance it won't get there at all because there won't be a conflict in the circuits.

On Trump’s side is the absurdity of the notion that the 14th Amendment was ever understood by those who voted for its passage, as granting citizenship to a child born here from a mother here illegally.
Going against Trump are later precedents established by Supreme Court decisions like (U.S. vs Wong Kim Ark) that don’t directly address the issue but come close. If SCOTUS is willing to take a fresh look at those earlier cases and perhaps challenge some of their conclusions, they could rule in Trump’s favor, and their willingness to reverse Roe v Wade offers some reason for encouragement in that regard. But It’s still a long shot IMO.

I doubt they will. There are absolutely a few instances where I’m glad this court overturned bad precedent (Roe, Chevron) but this would be a terrible idea with untold, unintended consequences.
I’d say something like “So you want President AOC to be able to strip Marco Rubio? Ted Cruz? of citizenship?” — but the crazy way things are nowadays, I imagine there would be a lot of HELL YES!

It’s funny how fast the justice system works when they want a specific answer...Meanwhile Trump still owes 450 million to NY and we await an appeals court.
How did the ninth circuit take ownership of that case. Why don’t the Republicans go to another more favorable district and have it okayed.
Because the someone residing in the Western District of Washington - joined by the state of Washington - sought relief in that district.
And the Western District of Washington is within the 9th Appellate Circuit, so the 9th District Appellate Court hears appeals from District courts within that circuit, as is true with every other federal district court in every other appellate circuit.
And this is how the US court system works.
I know people have gone crazy with believing the “courts” are a Choose Your Own Adventure matter of picking a court, but FFS already.... This is how districts and appellate circuits have worked for 250 years.

The 9th circuit takes in 3 or 4 western states. It would seem following Supreme Court logic when they decided the national injunction issue re lower district courts that they may not extend injunctions outside their jurisdiction that appellate courts, much like district courts, cannot extend injunctions outside of their jurisdiction. Botton line only the Supreme Court can issue nationwide injunctions. Texas can tell the 9th circuit to go to hell
