The legal attack on trans teachers’ free speech is a much broader warning

The 11th U.S. Circuit Court of Appeals ruled last week that a trans teacher in Florida has no right to refer to herself with the gendered honorific “Ms.” or ask to be referred to with the pronouns she/her under what critics have called Florida’s “Don’t Say Gay” law.

The trans algebra teacher, Katie Wood, sued her employer, the Hillsborough County School Board, in 2023 soon after Florida’s anti-LGBTQ law was enacted. A lower court found that the law likely infringes on her First Amendment free speech rights and granted a preliminary injunction. However, the conservative-leaning appeals court overruled the lower court, ruling that Wood has not shown that the law violates her free speech rights as a citizen.

According to the law, teachers are explicitly forbidden from providing students with their honorifics or pronouns if they do not correspond with the words most closely associated with their assigned sexes at birth.......

Block notes that other conservative-leaning courts have begun ruling that teachers have an inalienable free speech right to misgender their trans students, because conservatives have claimed that being required to respect a student’s pronouns would essentially be the state’s forcing teachers to express a political and/or religious belief that they do not hold.

But the same should be the case for a trans teacher referring to themselves. If a conservative teacher is allowed to misgender their students as a matter of political speech, so, too, should a trans teacher be allowed to gender herself correctly. But conservatives do not really care about legal consistency — they want to have their cake and eat it, too.

American conservatives seem to think they have won the cultural battle over trans rights in the wake of United States v. Skrmetti, which upheld state laws banning gender-affirming care for minors.

Never accept the enemy's premise! In this case the "trans" teacher (which should be forbidden in the 1st place) should be required to use their birth and/or DNA pronoun.

If some guy wishes to be called “Miss”, that’s fine.

However, I don’t see why someone with such an obvious psycho-social disorder should be allowed to control MY speech.

If the employer is following the law, then the complaint is not with the employer, but rather the state making the law. A lawsuit against the employer should be thrown out if they are following the state law. If you think the law is against federal law and steps on your federal rights, then go after the state.

Personally, I see no problem with the law as it is.

Why a school would hire an obviously mentally ill person to teach kids is beyond me. But maybe more to the point does the pretend woman or pretend man have the right to require students to go along with his or her delusions? And do the parents have the right to pull their kids from his/her class?

What does the esteemed journalistic style guide say about when to use "what critics call a law" vs. what the actual name of the law is? Does this work the other way? Can we get the MSM to call abortionists "baby-killers"?

I thought about making the point that parents should be able to opt out of trans teachers for their (our) children. But semi covered with with In this case the "trans" teacher (which should be forbidden in the 1st place)

If the teacher wants to call himself a ‘banana’ he absolutely can do that.

But he can’t force anyone else to call him a ‘banana’.

A teacher has the right to say what she likes, outside the classroom.

She does not, though, have the right to lie to his students.

We’ve gotten away from in person interviews. Back in my day you walked in any place and asked for an application. You phoned and made in person appointment. If you were a freak, you didn’t get hired.

It’s not about what the teacher wanted to call themself. It’s about forcing what others are required to call them. It’s not free speech but wanting compelled speech. If this were not Florida, a person misgendering them would be suspended for hate speech. In Europe it gets you arrested.

No problem with him changing his name to Katie and being called by that. But by insisting (forcing) staff and students call him “Mrs.”, “Miss” or “Ms.” he is infringing on the free speech rights of others.

We need a new made-up word for trannies (like Ms. was made up for women who don’t want you to know their status).

It could be Mix Katie? (Because he is mixed up!)

That a mentally ill man who thinks he is a woman is a teacher is child abuse. He should be in residential care to get help for his mental illness.

How can I know what the correct biological gender of a person is especially considering medical and educational privacy laws.

Teach the freaking kids. That’s what you were hired to do. Anything after that is your problem, not the student, parents and community’s problem.
