Bryan Malinowski widow files wrongful death lawsuit against U.S., ATF and 11 agents over fatal raid

LITTLE ROCK, Ark. — A wrongful death federal lawsuit has been filed against the Bureau of Alcohol, Tobacco, and Explosives (ATF) and at least 10 agents after Bryan Malinowski, who was a director at the Clinton National Airport, was killed in an early morning raid.

The lawsuit was filed by attorneys for Maria "Maer" Malinowski, the wife of Malinowski, and alleges "agents chose the most aggressive tactics available" to serve a search warrant on March 19, 2024.

The complaint alleges the constitutional rights of the Malinowskis' were violated, with attorneys calling his death a "needless and a direct result of the unreasonable and unconstitutional conduct of the ATF agents."

Basically he was murdered by ATF for lowest level, non violent regulatory (ATF) laws to "send a message" to kitchen table "dealers".

The charges:

As of Thursday, there was no reply to the complaint and no indication as to what the next steps will be. The case has been assigned to U.S. District Judge Brian Miller. The U.S. Attorneys Office civil division will handle the initial defense.

Bud Cummins, who served as U.S. Attorney for the Eastern District of Arkansas from 2001 to 2006 is representing Maer Malinowski.

The complaint names as a cause of action 13 counts:

— Failure to knock and announce;
— Unlawful entry;
— Use of excessive force;
— Illegal detention of Maer Malinowski;
— Wrongful death;
— Assault and Battery;
— Negligence;
— Intentional infliction of emotional distress;
— Arkansas Victim of Felonies Act — manslaughter and negligent homicide;
— Arkansas Victim of Felonies Act — battery;
— Arkansas Victim of Felonies Act — aggravated assault;
— Arkansas Victim of Felonies Act — criminal mischief;
— False imprisonment of Maer Malinowski.

A news release issued Thursday by Graves Garrett Greim LLC, the Law Offices of Bud Cummins PLC, James and Carter PLC and the Riordan Law Firm PLLC, said that Bryan Malinowski posed no threat to ATF agents that, “believing that he would fully cooperate,” planned a pre-dawn raid in full tactical gear, covered a video doorbell and, “less than 28 seconds after they started knocking at the outside storm door,” pried open the storm doors and broke down the main doors with a battering ram.

Guns mentioned in law suit and warrant. Note. Bryan used gunbroker.com to ship firearms to FFL. He did a 4473 and multiple gun sale form. Shot them in the range and then resold. Since he made 300k as LR city employee, selling guns was not his primary income and thus, probably didnt need FFL.

But nope, ATF wanted to "send a message" with this stunt and murdered this poor guy.

F the Ftroop. Hope they all go to jail.

Anyways, here the guns:

According to the search warrant affidavit that led to the issuance of the search warrant, after the ATF submitted a trace request to the National Tracing Center it received reports showing that Bryan Malinowski had purchased “approximately ninety-two (92) firearms from November 2021 to December 2023,” including approximately :24 Glock Model 4 pistols, nine Fed Arm Model FR-16 pistols, nine Beretta Model 92A pistols,
seven North American Arms Model NA22 pistols,
four Glock Model 22 pistols,
four SAR Model SAR9 pistols,
three ATI Model OMNI pistols,
three Glock Model 19 pistols,
three Glock Model 17 pistols,
three Beretta Model 92FS pistols,
and “multiple different handguns where he purchased two of the same manufacturer and model firearms.”

All of the firearms listed on the Multiple Sale Summary reports, the affidavit said, were purchased from the same firearms dealer located in North Little Rock, the name of which was redacted in the affidavit.

Trump should force the ATF to admit its full guilt. Then use that admission to clean house there if not abolish the agency entirely.

There was zero need to bust down his door and send a SWAT team into his house early in the morning with no advance warning. He was not violent. This could have been handled with a discussion in an office.

You know they wanted a shoot out because they had on all the bullet proof gear. So they cannot argue that they weren’t trying to induce a gun fight. They knew there were guns in the house. They gave him no warning. He had to choose in a sleepy state to defend or give in. Arkansas has violent crime. So the agents prepared for a shooting. They did not knock. They could have killed his wife as well. They did not care. The people who planned this are evil. This was not a mistake. It was not a mishap. It was an execution.

This is why you need to be able to take a dump or a shower within 15 seconds.

If asleep, you must also be able to rouse yourself to being fully awake and alert within the same time.

IIRC they give you 60 seconds to shower on a sub.

Give ‘em whatever they’re asking for. Settle without a trial. DOGE dividend. Barring that, drag ATF’s abuses through the limelight, and then give them whatever they ask, plus court costs.

And make Dettelbach their butler.
