The Supreme Court ruled Tuesday that the Trump administration can move forward with a ban on transgender military service members for now, lifting a lower court injunction against the policy after a judge ruled it was an "unsupported, dramatic and facially unfair exclusionary policy."
The court did not explain its decision other than to say the order would expire if the justices ultimately take up the case on the merits and issue a ruling striking it down.
Litigation continues in the Court of Appeals for the Ninth Circuit.
Justices Sonia Sotomayor, Elena Kagan and Ketanji Brown Jackson indicated they would have denied Trump's request for a stay.
During Trump's first term, the high court took a similar course, lifting an injunction against a ban on transgender service members after it was challenged. President Biden ended the policy and around 1,000 transgender members of the military have provided active service over the past four years.
At the end of April, the Trump administration made a new emergency request seeking an immediate stay of a nationwide injunction blocking the ban on openly transgender military service members.
Solicitor General John Sauer said the injunction, issued by a district court in Washington, usurps the authority of the president in determining who can serve in the nation's armed forces and runs counter to the high court's own decision in the first Trump administration to allow the ban to move forward.

“For now”?
Not “Settled Law”?
The Supreme Court allows the president to be the president and commander in chief? Big of them. By not flat out slapping these judicial jack wagons down Mr Trump is encouraging them to go for their big power play.
Ultimately, congress will need to resolve this so that the next ‘Rat president can’t just undo the ban.
how will helicopters power their rotor blades without transmissions?
You’re absolutely right.
By mau mauing him over the last 8 years they have cowed him into doing their bidding.
This is just a little reprieve. But Roberts clearly considers himself the ultimate arbiter of all decisions in the United States, and the Constitution is his to rewrite.
That's completely normal given the procedural status of the case.
If my 2nd degree black belt daughter was denied entry in an armed service 20 years ago because she has arthritis in ONE FINGER, how is it this massive and major medical nightmare is okay to exist in todays armed forces.
The ban basically has been in place since Trump took office.
The military doesn’t have to say a word to any potential recruits. Recruits have to take physicals.
If any slip through the cracks, they will he quickly winnowed out during basic training.
RE: Justices Sonia Sotomayor, Elena Kagan and Ketanji Brown Jackson indicated they would have denied Trump’s request for a stay.
No kidding.
They were always firm about voting together as they cackled over their cauldron. Ready to vote before any testimony or precedents were presented. Down with Trump. Down with males.

I hadn’t thought of that, however I certainly won’t miss that whine from underneath my car.
The dirty little secret is that if any Trans person is recovering from surgery, needs daily, monthly therapy/medicine (surgery or not) THEY ARE NOT DEPLOYABLE in any armed service.
Notice the different source (and title)?
“Transgender” individuals are a LIABILITY to any effective military organization. These people are suffering from a disability that limits their deployment and effectual capabilities, even in non-combat roles.
This is much like hiring paraplegics and PSTD victims to hold positions of responsibility in a military organization. Not practical. And by no means, does it help the individual in any way, shape, form or manner.
Agree Fully.
Who is the commander in chief again?
Aside from the undefinable “ diversity” I have not heard a single person say what benefit trannies bring to the military.
Thank God
