Former Republican Alaska Gov. Sarah Palin has lost her defamation suit retrial against the New York Times.
The federal jury ruled after just two hours of deliberation on Tuesday that the New York Times was not guilty of libel when it falsely linked her to a 2011 mass shooting in an editorial it published in 2017. Per Axios:
Throughout this trial and the original 2022 trial, the Times asserted that the inaccurate link made in the editorial was a mistake.
It issued a formal correction of the piece, titled “America’s Lethal Politics,” two days after it was originally published on June 14.
Palin and her legal team argued that the Times and its former editorial page editor James Bennet for libel used “actual malice” in publishing the editorial.
A New York Times spokesperson said in a statement that the jury’s ruling proves “publishers are not liable for honest mistakes.”
“We want to thank the jurors for their careful deliberations. The decision reaffirms an important tenet of American law: publishers are not liable for honest mistakes,” the spokesperson said.
As Breitbart News reported in February 2022, U.S. Judge Jed S. Rakoff, a Bill Clinton appointee to the federal bench in the Southern District of New York, dismissed the case even as jurors were still deliberating over the verdict:

She didn’t have much of a case to begin with. Defamation is very hard to win. Glad she went down swinging, though. I read she made the NYT guy cry.

Yet Trump gets a defamation verdict against him in NY just for denying an accusation of assault. No conservative can get a fair trial in NYC.

And especially so if you’re a public figure. You have much less protection. But as you noted, at least Palin gave it a try.
It is ironic that the supposedly most sophisticated and forward thinking city in the US has such corrupt governmental institutions that tin pot turd world dictators can only aspire to have them. These people have no principles and no shame, and no inkling as to how thuggish they really are.

If you are sitting on a jury there, you know full and well that someone has your name, address, email, phone, relatives, place of employment, favorite lunch spot, and more all neatly laid out in a spreadsheet. If you do not return a correct verdict, your life in NYC is over, and you had better be packed and ready to move.
What I don’t get is why they are all OK with this?
She should have learned from Trump about biased, corrupt NY judges and juries.
She was never going to win there, just as Trump will never win there.

The CO law Tina Peters was convicted of required criminal intent. The judge just made up his own claims about her intent after forbidding her to talk about her real reason, which was election integrity.
The law only means what a judge can get away with saying it means. Using the precedent in CO, this judge could have said, “NYT, you can’t give us any reasons why you thought what you were saying was fine. I say you had malicious intent. Off with your heads.” (after railing for 5 minutes about what terrible people they are and they should be ashamed, blah blah blah)
Apparently the same thing happened yesterday.

Sullivan v New York Times was wrongly decided. Application of the ordinary defamation standards would help check the wanton lies of the
