Raskin: Boasberg a ‘Great Judicial Hero’ for Contempt Ruling Against Trump

Representative Jamie Raskin (D-MD) claimed Wednesday on CNN’s “News Central” ” that U.S. District Judge James Boasberg was a “great judicial hero” for finding probable cause to hold the Trump administration in criminal contempt for disobeying his order to halt deportations.

Raskin said, “Judge Boasberg goes to great pains to restate the precedent going back to 1967, Walker vs. Birmingham, holding that you’ve got to comply with a court order, even if you know, they were in the wrong court, even if for some reason there’s a change. Look, Judge Boasberg, who was a President Bush appointee when he originally went on the bench and he was Justice Kavanaugh’s roommate at Yale, will go down in history as a great judicial hero for what he’s doing here.”

He continued, “He is trying to put up a huge stop sign against the lawlessness. He said I issued an injunction for you to not let those planes go, or if they were in the air to turn them around, they hadn’t left yet but you willfully, deliberately defied a court order. You can’t do that. Even the President of the United States can’t do that. The Executive Branch can’t do it. The Legislative Branch can’t do it. No citizen can do it. You cannot defy the order of a court.”

Some writers have theorized, there’s actually two constitutional ways of removing a federal judge — by impeachment and by a simple majority in the Senate. In other words. a federal judge can be voted out the exact same way he was voted in.

The question is: Where is Roberts and the USSC on the use of Lawfare, and Article 1 of the U.S. Constitution?

It all would be stopped immediately, IF we had a USSC that invoked the Constitution.

Seems logical, except that would require Republicans to use what they don’t have — backbone, guts, balls — it would only take one of those organs.

What a great judge. A special appointment to oversee FISA court reforms, he gets lied to and issues the warrant to spy on a Presidential candidate. Then, then when the lie is exposed gave Clinesmith probation rather than the recommended prison time! What a tough, law abiding judge…… /s ……. Judge, you’re gonna go down in history as the most crooked, political hack of a person to ever sit on the bench!

Having a little personal experience with indirect contempt of court, I need to say that the failure to comply with an unlawful order is ann anbsolute affirmative defense. According to SCOTUS never had jurisdiction due to lack of venue. Hence, every order issued by him in this case was lawful, and could be ignored. We lawyers call that black letter law - meaning that it is so settled that it is in bold black letters.

Yes, they both can defy a court order. And no federal judge can order an aircraft in the air to go anywhere.
Congress can indeed defy and overrule a judge with legislation, or abolishing the court, changing it’s jurisdiction, OR impeachment. Congress can also overrule the judge by refusing to impeach Trump for ignoring it.

This is a serious overrating of the judges powers.

Constitutionally, Congress is the most powerful, the Presidency a close second, and the judiciary a distant third.
