BREAKING: Two Federal Judges Temporarily Block Removals of Alleged Venezuelan Tren de Aragua Gang Members in Alien Enemies Act Case After SCOTUS Ruling

Two federal judges on Wednesday blocked the removal of Venezuelan nationals and alleged TdA gang members facing deportation under the Alien Enemies Act after the Supreme Court’s ruling on the Kilmar Abrego Garcia case.

US District Judge for the Southern District of Texas, Fernando Rodriguez, Jr., a Trump appointee, issued a temporary restraining order (TRO) through April 23 or until he issues an order.

“Respondents are enjoined from transferring, relocating, or removing J.A.V., J.G.G., W.G.H., or any other person that Respondents claim are subject to removal under the Proclamation, from the El Valle Detention Center; and Respondents are enjoined from transporting such persons outside of Willacy County or Cameron County, Texas, without an Order from the Court,” Rodriguez wrote in his TRO.

Another federal judge in New York issued a TRO after two Venezuelan nationals filed a lawsuit to challenge their removal.

US District Judge Alvin Hellerstein, a Clinton appointee, blocked the removal of two alleged Tren de Aragua gang members in New York.

This sort of invites the goverment to bring said gang members to the court, and the court can take care of these dudes.

If I understood correctly, the previous USSC slap down was for basically not being in proper jurisdiction, but did not rule on merits. Now the merits will be heard.

Republicans, in general, follow the law. Democrats are showing that on a routine basis, they ignore the law.

Yes- no authority to issue blanket stays, only for each individual.

Curious to know what grounds they even have for a habeas petition.

The court said individuals can bring habeas corpus cases one by one. These appear to be named individuals so perhaps it is in line with the ruling. That DC guy tried to bring a ruling on a class of people. That’s what was overturned.

Why would the dems want to keep violent criminals in the USA?

- because they hate the USA and want to turn it over to thugs who will vote democrat.

More than that: it blocked all blanket actions, which this order appears to be violating. Habeas petitions require a case by case consideration.

Ah, more reporting from the hack Cristina Laila.

Does she know the TRO is in place because the alleged TdA members have filed habeas petitions and those petitions must be acted on? Per a 9-0 ruling from the USSC?

My gosh, she is such a journalistic hack.

Ah, yes, I stand corrected. So what would be the proper DOJ action now? I would think they just ignore and tell the judges to pound sand. Meanwhile Roberts should be saying something, but he probably wont.

This is a class, which is expressly forbidden by SCOTUS' order.
