Baldwin: Trump Is in Violation of the Impoundment Control Act of 1974

Senator Tammy Baldwin (D-WI) said Monday on MSNBC’s “Morning Joe” that President Donald Trump was violating of The Impoundment Control Act passed in 1974.

Co-host Joe Scarborough said, “So since you’re on the Appropriations Committee, you’re the perfect person to ask. Is the continued impoundment by DOGE of funds authorized and appropriated by Congress, is that a constitutional violation of Article I powers?”

Baldwin said, “It absolutely is. And it is so clear in Article I that Congress makes the laws, passes the budgets and the appropriation bills. And it is the administration, the president, who implements and administers those. And we’re seeing conflict there, started with that federal funding freeze, and of course, lawsuits were filed immediately, but the harm occurred. We had head starts in Wisconsin that closed 250 families in Waukesha, Wisconsin, displaced for a week because they couldn’t access the federal funding to run their head start program. And in the courts, of course, we got a stay of those freezes. We got a rescission of the OMB directive.”

Because most spending is not “designated” by line item, the Impoundment Act id not applicable.

Also, for the “firings” most employees will continue to get paid through the end of the fiscal year—so the allocated money will be spent as the spending bills dictate.

I am pretty sure this was all thought out over the past couple of years.

Even not going deep he misleads. The power of impoundment was used routinely by Presidents up until the 1974 act which was a reaction to Nixon doing what Presidents routinely do.

Then it should be so clear to Tammy that Congress is making unconstitutional laws about things that the Fed govt has no control over.

President is not out of line to thwart that. He is actually trying to right House and Senate repeated abuses of tax payers by overstepping their Constitutional limitations (State matters vs Fed matters) and forcing taxpayers to foot the bill for huge amounts of unconstitutional things.

The law is what the ruling majority of all three branches says it is, with the Judicial branch's option having final say over the others via "Marbury vs Madison.

This is the reality of how our Government has evolved.

SUBJECT AND PURSUANT TO THE CONSTITUTION (Art. VI, Cl. 2), much of which is not.

It is not unconstitutional to stop unconstitutional gov't acts and spending.

I haven’t been in this as it is really simple to figure out. But as these liberal idiots keep throwing stuff against the wall it gets old. So let me throw in my two cents.

Congress does not hire or fire people in government positions. Those positions are not made up of people that answer to congress. They are slots that are determined needed to complete the mission and it’s up to congress to figure out how much money they can provide to pay for that slot. And it is not up to congress to determine the worth of the employee as that is handled by first line supervisors and action taken by them or close up the chain. This is in their job description.

So once someone creates the slot, and the funds made available, it is not up to congress to determine the accomplishment of the person in the slot. Whether that person is fired for ineffeciency or dishonesty has nothing to do with the money congress appropriated to that slot. That money will continue whether there is a person in the slot or not. It just won’t be paid until there is someone hired there to earn it. So once congress says okay for the money that the lower level asked for, it has nothing to do with congress or the slot anymore. It is up to the lower level supervisors to make the train run correctly. And that’s part of what happened and it falls under fraud, waste, and abuse.

It was passed in the wake of Watergate to limit the President’s power that had been used for killing worthless pork barrel projects for decades by presidents of both parties.

That’s when the budgetary process went haywire..................
