Alan Dershowitz Puzzled by Courts Overstepping into Trump’s Presidential Powers

(American Political Report)—A legal expert expressed confusion and concern over recent judicial actions that he believes significantly encroach upon the authority of President Donald Trump.

Harvard Law professor Alan Dershowitz, speaking on “Hannity,” highlighted what he sees as an unusual level of judicial interference. Dershowitz argued that the courts are stepping into areas traditionally reserved for executive decision-making, particularly in matters related to Trump’s actions while in office.

“The courts are intruding significantly into the core areas of presidential authority,” Dershowitz stated. He was particularly critical of judicial decisions that he believes set a dangerous precedent by undermining the separation of powers, a cornerstone of American governance.

Dershowitz pointed to several cases where courts have ruled against Trump, including issues related to national security and immigration policies. He questioned the legality and the long-term implications of these rulings, suggesting that they might deter future presidents from making bold executive decisions for fear of judicial overruling.

He emphasized the importance of judicial restraint, warning that unchecked judicial activism could lead to a weakening of the executive branch’s ability to act decisively. “There has to be some deference to the president’s authority,” Dershowitz argued, adding that while no one is above the law, the courts must recognize the constitutional powers of the presidency.

The discussion also touched on the potential politicization of the judiciary, with Dershowitz suggesting that some decisions might reflect political biases rather than purely legal considerations. He called for a return to judicial norms where courts respect the executive’s domain unless there’s clear evidence of constitutional violation.

This commentary comes at a time when debates over the balance of power among the branches of government are increasingly prominent, especially in light of actions taken by the judiciary in high-profile cases involving President Trump.

If the NSDAP had gone into federal court back in 1943 to get an injunction against further bombing raids on German cities and industrial targets, they could probably have shut down the Army Air Corps.

It’s only puzzling if you expect partisan judges to be anything other than partisans.

Alan is a liberal, not a leftist. The judges are leftists, as is the entire democrat party. It’s past time for him to realize that leftists are tyrants and nothing more. They have no principles.

It really isn’t that confusing.

Obama and Biden, and even Bush, packed the courts with judges who never thought their job was to protect the Constitution, never intended to live by their oath. Hell, they prob never even READ the document.

Their one and only job was to push the agenda and to hell with the Constitution and screw the people. Purge these people.

I am not sure why he would be puzzled. We have known the judicial system to be corrupt for a few years now.

Unelected judges creating laws without any consequences are the real threat to democracy and has been for decades, they are just getting bolder since they feel they can use “Orange nazi” as justification for their naked power grab.

Imagine if the atom bomb secret had leaked and some peacenik group had asked for an injunction against using it to end WWII?

I know what would have happened.

The Peaceniks would have been seized and tossed in a nasty federal prison and interrogated as enemy agents.

Any judge that ruled in their favor would have been treated the same way.

The elected President .. where did judges start being a higher power than a President overwhelmingly elected ..
The Supreme Court, where does it fit in this equation?
Is it a new power grab, to dis Trump and think they can make decisions .. like hunter did ?
I heard the report is hunter has been the acting President. While the Dems let it ride, unhindered.. But, hey, can’t let, Trump have a good week..
