Special counsel Jack Smith’s report on President-elect Donald Trump will be released to the public, Department of Justice (DOJ) officials said on Jan. 8. Attorney General Merrick Garland intends to release part one of the report, which deals with Trump, “in furtherance of the public interest in informing a co-equal branch and the public regarding this significant matter,” officials said in a court filing to the U.S. Court of Appeals for the 11th Circuit.
Smith has already transmitted the report to Garland, officials said.
U.S. District Judge Aileen Cannon on Tuesday had ordered the department not to release the report until the 11th Circuit reviewed a motion by Walt Nauta and Carlos De Oliveira, Trump’s co-defendants in a federal case.
While prosecutors dropped charges against Trump following his November 2024 election win, they are still pursuing Nauta, a former Trump aide, and De Oliveira, a manager at Trump’s resort in Florida.
Nauta and De Oliveira say Smith should be fired and that his report should not be released to the public, given he was found by Cannon to be unconstitutionally appointed.

I think it would be a violation of the Bar Rules on Ethics. A prosecutor can’t make public statements about a case he’s working on, with limited exceptions. A special prosecutor who has a statutory mandate can do it obviously, but Smith is not appointed pursuant to a statute.
Why can’t they wait to release the report?
Yet another fiction to be published by yet another hostile 3-letter agency of the occupation government.
It has as much credibility as the Steele dossier.
Maybe Cannon will threaten to jail Garland and Smith for contempt of court.
Because once Trump is inaugurated they won’t be able to release that garbage.
So now you can disobey a court order with impunity?
Garland wants to smear Trump before he can pardon the J6 protestors. Trump has never been allowed to defend himself from these scurrilous charges. Despicable.
When has this ever been done? No case, no report. Just like Matt Gaetz who resigned and protocol in the House was to never release ethics reports on members no longer in Congress.

Just like Judge Merchan not waiting to sentence Trump until after the inaguartion— so they can call him a convicted felon during the ceremony.
