The respected Islamic official’s critique argued that the damage inflicted on Gaza, as a result of Hamas’s attacks, was a breach of Islamic law.
Professor Dr. Salman al-Dayah, a former dean of the Faculty of Sharia and Law at the Islamic University of Gaza, issued a fatwa against Hamas for their October 7 attacks, the BBC reported on Friday.
Fatwa is an Islamic religious decree made by a recognized Islamic jurist, Faqih, as a response to a question asked by a judge or government.
The document accused Hamas of “violating Islamic principles governing jihad.”
Dayah added, “If the pillars, causes, or conditions of jihad are not met, it must be avoided in order to avoid destroying peoples' lives. This is something that is easy to guess for our country’s politicians, so the attack must have been avoided.”
The October 7 attacks saw terrorists invade Israel’s southern border, murder some 1200 people, and abduct over 250 more. Over 100 living and dead hostages, including women and children, remain in Hamas captivity as the terror group continues to reject attempts to negotiate for their release.
Noting Hamas’s well-documented use of civilian infrastructure, Dayah condemned Hamas for failing in “keeping fighters away from the homes of defenseless [Palestinian] civilians and their shelters, and providing security and safety as much as possible in the various aspects of life... security, economic, health, and education, and saving enough supplies for them.”
Fatwas against Hamas Dayah’s fatwa was not the first issue against Hamas, as the Islamic Fatwa Council announced in March they would be issuing a fatwa against Hamas for "violating the laws of the Holy Koran."
"We believed it was our Islamic obligation to aid the oppressed," IFC Spokesman Sheikh Muhammad Ali al-Maqdisi said at the time. "Our faith, in its wisdom, enjoins us to be an enemy to the oppressor and an aid to the oppressed. That is why the fatwa was issued against Hamas."
Palestine is no more. The coalition members are going to take control and over an extended time create a new state that is absent all the old order.

Scholars can issue fatwas? I thought only top imams could do that. Who knew. That means almost anyone can. I can say I’m a scholar too. A fatwa for everyone like Oprah said you have a car and you have a car.
The real story here is that Gaza has a university?
I majored in Jihad at Gaza U! With majors like Rubble Management, Beheading, Goat Raping, and Tunnel Engineering in the STEM department.
They did not condemn Hamas for the attacks
They condemned them for the blowback against Muslims.
War with Islam.
We know that it’s coming.
It is a religion of hate.
Period.
That’s how I read it. If the Jihad is going to cause us too much blowback, then it’s unislamic.

No, you are wrong. The Arab states that matter... Egypt, Saudi Arabia, the UAE and maybe Jordan, will work together at assigned tasks to along with Israel and the USA, create a totally new state where Palestine once existed.
President Trump provided the leadership and an envoy, Jared Kushner, to accomplish what they all wanted but couldn’t accomplish without the Trump leadership.
Yes, it’s hardly an unequivocal call for peace, but then again they’re constrained by the tenants of their own religion. It’s probably the best one could expect from them at the moment.

He would be in trouble, if there was any Hamas left to punish him. My guess is this guy is making some kind of play to replace Hamas. In the early years Hamas was a strictly humanitarian organization they had no armed wing. That’s what made them popular among the people. They armed themselves at first as opposition to Oslo and the PLO governance. So it makes some sense some group will need to step in and cover the humanitarian aspect now that Hamas is out of the picture and UNRWA being kicked out. Just a guess. If not a play for himself personally perhaps to inspire a new spiritual, non-violent movement.
