The Justice Department announced a lawsuit Friday against Alabama, arguing the state’s effort to remove noncitizens from its voter rolls came too close to the November election.
The department asked a federal judge to order Alabama to put the names — which the state says are ineligible voters — back on the active voter lists. The department said some actual citizens were sent notices that they had been moved to the inactive voter file.
Alabama announced the move on Aug. 13. That was 84 days before the election, violating the federal National Voter Registration Act, better known as motor-voter, which prohibits deleting names from election lists within 90 days of an election.
“As Election Day approaches, it is critical that Alabama redress voter confusion resulting from its list maintenance mailings sent in violation of federal law,” said Assistant Attorney General Kristen Clarke. She said the lawsuit should be a warning to other states.
Alabama Secretary of State Wes Allen said at the time that his office had identified 3,251 names of people on the lists to whom Homeland Security had issued what he called a “noncitizen identification” number. His office instructed registrars to inactivate those names and “initiate steps” to remove those who were found to be noncitizens.
Mr. Allen said Homeland Security refused to cooperate with his efforts.

Alabama should refuse. It is illegal for noncitizens to vote. It is never too late to stop a fraudulent vote.

Check the constitution - the state has sole determination of voter eligibility. Theres been amendments to make exceptions (slaves, all men (regardless of land ownership) and later women) but AFAIK there’s no amendment to allow non-citizens the right to vote.
as American citizens, i believe we all have standing to bring charges against the DOJ for not enforcing immigration law and against the executive branch for actively breaking immigration law by flooding the country with foreign persons bent on harming Americans

I wonder if Alabama refuses the DOJ’s request to reinstate the voter registrations. I suspect that this will go to the U.S. Supreme Court.
On September 6, 2023 six Colorado voters sued to block Trump from being on the ballot for President. The issue was finally decided by the U.S. Supreme Court March 4, 2024, nearly 6 months after the lawsuit. September 28, 2024 is less than 2 months from November 5, 2024. Given how slow the courts work, there is a chance DOJ will fail.
Trump needs to go after these DOJ people on Day one. There is only one reason for them to do this. And that is to steal an election. It could not be anymore obvious.
If Alabama is required to keep these non-citizens on the official rolls, here’s what the state should do:
Notify all these non-citizens that they are still on the official list because of the Federal law, but if they do vote, they’ll be arrested and charged. And then after the election, Alabama should follow through and charge any of the non-citizens who voted.
My guess is that a letter stating that is all that will be needed; probably none of them will vote after being specifically warned not to, under threat of being charged with a crime.

If that’s the law, then there should be no registrations allowed within 90 days of the election.
There is registrations allowed within 90 days, so the law prohibiting removing illegals from the voter rolls must be allowed anytime illegals are allowed to register.
