The Wisconsin Elections Commission, which is represented by the Wisconsin Department of Justice, filed a petition to the Wisconsin Supreme Court to take up Robert F. Kennedy Jr.'s case to remove himself from November ballots.
The commission also filed it's response to Kennedy's legal appeal.
The petition argues the case is "highly time sensitive and hugely consequential for a the people of Wisconsin." It states Kennedy's proposal to use stickers to cover his name is poorly conceived, would require thousands of hours of extra work and create a logistical nightmare.
Robert F. Kennedy Jr.'s legal team filed a brief in his appeal Thursday as he seeks removal from the presidential ballot in Wisconsin, in part asking the appeals court to allow for different-looking ballots for different sets of voters.
The appeal came as local clerks mail absentee ballots to voters who have requested them.
The Wisconsin Elections Commission argued Kennedy's sticker idea could jam vote-counting machines and that said machines had not been tested with the stickers. Kennedy's appeal argued that the WEC's claims are pure speculation. The commission's response states ballots are made with specialized printers and tabulation machines notice even a small mark. It argues the stickers could cause a machine to register a double vote.
Kennedy's team argued that, in the event that a candidate died, then stickers would be used. Thus, they can be used to remove Kennedy's name.
One key aspect of the brief is answering what will happen with ballots that have already been mailed to voters. Thursday marked the deadline for clerks to send ballots to voters with an active request on file, which means ballots with Kennedy's name on them are already in the mail.
Kennedy's answer to that question? "What's been done is done."
In the brief, Kennedy explicitly says he is not asking for a second set of ballots to be sent out, just for stickers to be placed over his name on remaining ballots.
That means that voters whose ballots are already in the mail, or in their possession, will have a chance to mark the box next to Kennedy's name. However, future voters will not.
Kennedy's appeal comes after a Dane County judge ruled to keep him on the Wisconsin ballot on Monday, citing state law that candidates who submit nomination papers before the Aug. 6 deadline can't be removed from the ballot unless they die.
That was the same law that the WEC cited when voting to keep him on the ballot even after he dropped out of the race last month and endorsed former President Donald Trump.
Kennedy sued the WEC, arguing that state law discriminates against independent candidates.
Only if it will benefit the Socialist Democrats in this state! Grrrr!
More 'lawfare' to punish Kennedy for jumping ship and supporting President in Exile Trump. I will keep you all posted if this is resolved in America's favor!
BTTT
Is there a reason anyone needs to vote 6 or 7 weeks in advance ?
Any decent mail shop of any size can machine apply blank labels over RFK Jr’s name on the ballots in record time. Our shop could do 75,000 an hour on one machine, and we have three of them.
It allows better opportunities for vote fraud and for stolen elections!
The only people that need to do this would be military peeps stationed overseas. Big lag-time in mail. And that’s what it was designed for in the first place.
The Socialist Democrats just ran with it and a lot of States went with it, too. I think there are 12 or 13 States now that do nothing but mail in ballots?
Am I the only one who finds it very curious indeed that not long ago the Rat Party was trying to keep his name *off* of ballots but now they’re trying to keep it *on* ballots?
How about Kennedy letting any supporters he may have in Wisconsin know:
he has withdrawn his candidacy and fully supports Pres Trump
the powers that be are trying to RIG and INTERFERE with the election
a vote for him is a wasted vote
if you believe in RFK then take his advice and vote for Pres Trump.
Advise his supporters that Democrat state “leadership” refuses to purge over 100k ineligible voters from the voter rolls bc they’ll be used to manipulate and take away your vote.
No! It’s insane. North Carolina begins now. Pennsylvania begins soon. All the battleground states are extremely early with voting.
States run their own elections and unless some basic Constitutional issue is at stake, Wisconsin law (and its courts) is the governing law of Wisconsin elections
I imagine SCOTUS will do nothing.
Indiana is sending them out next week as well. If RFK Jr wants to get his name off in states where he is running Independent that is fine, depending on state laws. But in states where he was nominated by a minor party in lieu of ballot access signatures, such as MI, it is up to the delegates to vote him off. He had an agreement with that party which benefited both sides and shouldn’t be allowed to break that contract unilaterally.
Wouldn’t it be easier to just print over his name? Like when FBI redacts stuff?
RFK is using the only means readily available to inform the public he is not running. The media won’t make any mention of it, but they are more apt to report on the court decisions. This is his only way to keep it public.
EC
Anyone stupid enough to vote for RFK after all the publicity
that he took himself out of the running should be forced to stand in the middle of Main St. and yell out 50 times, “Im an idiot!”.
You're right, but I bet I could come up with a constitutional issue.
I imagine SCOTUS will do nothing.
TBD.
That too!
I was thinking the same thing. They aren’t even trying to hide the corruption in the election system.
I’m not saying this is a strategy BUT it could help tremendously in 2028 if he runs again Independent and gets enough votes in 2024 to ensure ballot access, federal funding etc.
The more challenges, the better! If changes are made the preprinted and “voted” fake mail-in ballots will have to be discarded and the Rat machine will have to start over again.
