The Manhattan District Attorney’s office won’t oppose former President Donald Trump’s request to delay his upcoming sentencing in his Manhattan criminal case, prosecutors said in a letter Monday, potentially punting the ex-president’s sentencing until after the election as he appeals an upcoming ruling over whether the verdict against him should be thrown out.
Trump has asked for the sentencing in his criminal case, now scheduled for September 18, to be postponed until after the November election, arguing he should have time to appeal a ruling set to come out on September 16 over whether the verdict against him should be dismissed.
Judge Juan Merchan is expected to rule on September 16 on the issue of the verdict, in light of the recent Supreme Court decision giving Trump some immunity from criminal charges, as the ex-president has argued the verdict should be thrown out as a result, because it means some of the evidence used at his trial should not have been admitted.
Prosecutors said in a letter to Merchan Monday they’ll defer to the court on whether to delay Trump’s sentencing, conceding there are logistics about the immunity ruling that still have to be clarified and saying they’re “prepared to appear for sentencing on any future date the Court sets.”

That or they dream of the optics of a sitting president being led away in handcuffs.
Merchan can still rule however he wants, and we know what he wants. SCOTUS really needs to step in. Again.
If Trump gets elected, that simply will not happen.
The DA is passing blame to someone else, namely the judge in the case. The judge did his job, and the DA doesn’t matter anymore. The DA is washing his hands and is pointing fingers elsewhere. Judge Merchan will do what the DA wanted all along. The DA is saying, ‘don’t blame me’, and expecting Merchan to complete the dastardly deal.

If they think it will help politically, they will sentence Trump and send him to jail.
If they think that would hurt Democrats politically, they will delay sentencing.
I hate to be cynical, but, political considerations will be part of the decision making on this.
Get funds out of New York.

It’s the optics and they know the immunity issue needs to be addressed fist and they don’t want to do that now because it quite likely will be dismissed and that looks even worse.

Bragg is getting his orders from Team Obama/Jarrett.
There must be a sense that Kamala’s non-campaign campaign is being effective.
But if she falls flat on her face, Merchan can push the nuclear option button of jailing Trump.

Right now, it falls on Bragg to review his case for presumed immunity impacts and report to the judge on any impacts to his case. Merchan could stay his sentencing date pending a report from Bragg on the state of his case. This would put the ball squarely back in the DA's corner.
At that point, Bragg could simply say that his reliance on "now" protected evidence is too interwoven into his case and closing arguments and recommend that the case be dismissed. That would be the "easy way" out.
The hard way is for Bragg to file an amended case and try to scale back the charges to give Merchan some cover to still sentence President Trump for something. However, Trump's defense would be able to challenge Bragg's assertions and that would then fall back on Merchan to rule.
Merchan's "easy way" would be to accept the motion to defer sentencing and order Bragg to submit a report by November 8 (give him the whole week) on how Bragg intends to move forward.
