Judge starts hitting brakes in Trump’s documents case

The federal judge overseeing former President Trump’s classified documents case granted his request to delay a few deadlines further so prosecutors can evaluate the Supreme Court’s immunity ruling.

Trump’s lawyers on Friday asked Judge Aileen Cannon for permission to file more documents to argue that the former president should be immune from prosecution in the case.

In their motion this week, Trump’s team proposed a schedule that extends through early September, meaning a ruling wouldn’t come until at least the fall.

On Saturday, Cannon, a Trump appointee, said prosecutors and special counsel Jack Smith had until July 18 to respond to the Trump argument requesting for a delay.

Cannon also postponed two deadlines in the case, which is only expected to cause a minor delay.

The former president has pleaded not guilty in the case.

Trump’s lawyers say the recent Supreme Court decision that grants presidents protections for official acts should apply to the case, in which he is accused of mishandling classified records and attempting to obstruct the government from retrieving them after he was out of office.

The former president’s team asked Cannon to halt the case except for the pending request for a gag order. His lawyers also noted Justice Clarence Thomas’s concurring opinion in the Supreme Court decision, where he questioned special counsel Jack Smith’s motivations and authority.

I don’t know that the Thomas concurrence questioned the motivations of Smith, but it does represent a huge flashing warning on the issue of the legality of his appointment.

[...but it does represent a huge flashing warning on the issue of the legality of his appointment.

Thomas raised the issue with brass knuckles, stating, “A private citizen cannot prosecute another private citizen, much less a former president.”

Here are my questions, if they rule that Jack Smith’s appointment was unconstitutional, how is Trump made whole? What is his restitution? What are the punitive damages?

These scumbags rifled through his wife’s underwear drawer and his son’s bedroom. There should be absolute hell to pay.

Agree. The appointment makes little sense to me.

I would think there would be a case for reimbursing all of Trump’s legal fees. But is there anything to compensate for injury, etc., short of suing?

If Trump’s legal fees for all of the bogus cases would be reimbursed to him, then it would be in effect free campaign PR for him. He’s gotten more popularity from the persecution than spending money campaigning would have gotten him. So bonus points if his persecution costs are reimbursed.

the documents case, georgia case, and j6 cases against Trump are all history about the supreme court ruling.

The only one still standing is the cases in NY which will easily be thrown out on appeal no matter what anyway. It’s over for the lefts lawfare.

If Jack Smith is deemed a private person, I would like to see him immediately arrested in Florida for all his actions against Trump. Hold him with no bail in the the worst FL prison a one slow walk everything.

Yes, if this turns out to be a wrongful prosecution by both Supreme Court ruling and improperly appointed prosecutor, it does seem that all legal fees need to be reimbursed. That won’t make Trump whole, but it would help. And the PR is valuable but the damage is still done.
