Gag orders, constitutionally dubious, are meant to protect the integrity of a judicial proceeding.
However, even with the trial over, the gag orders imposed on former President Trump are not going away.
DA Bragg’s office (which had just freed the antisemitic Columbia Hamas rioters) demanded a continuation of the gag order which prohibits him from commenting on the individuals involved in the trial.
Since Trump is also running for president and Biden is spending $50 million to attack him over the various Democrat trials imposed on him, this effectively bans a presidential candidate from debating a campaign issue.
The New York Court of Appeals claimed that “no substantial constitutional question is directly involved” in gagging a presidential candidate when in reality several are involved.
But weasel words like “substantial” and “directly” give away the game.
Imposing a gag order post-trial on a potentially indefinite basis has no legal validity. There is no longer a judicial proceeding to protect. The basis for Bragg’s demands is the DA’s claim that he’s still getting death threats and that Trump may seek revenge. There will be plenty of people who hate Bragg regardless of what Trump says and the rationale that the rhetoric poses a personal risk rather than a risk to a case allows for a permanent gag order.
It also shifts away from protecting judicial proceedings before and during to protecting them afterward, and from restricting speech by a participant in a legal proceeding to restricting speech that political agitators believe threatens them.

They would not defy the Supreme Court,at least not for that.
If the DOJ were to defy the Supreme Court after the nakedly political persecution of Donald Trump in four separate courts along the East Coast, and after Meritless Garbage decided to ignore a Congressional subpoena in just the way that Bannon did, and do this all a few months before the election, it would be absolutely devastating for the Democrats. As it is, they are sliding in the polls, this would be like Mrs. O’Leary‘s cow kicking over a lantern in the barn.

I think you’re right. I was thinking he wouldn’t send him to jail as there would be issues with the secret service, but that is true: House arrest would give him the opportunity to telecast, use the net. These domestic enemies - which is what I call them now - want him completely destroyed, dead, neutralized, a complete non-threat to their goal of absolute power.
It’s amazing to me, every day how unaware people are that the life they enjoy, their freedom, can all be gone forever by November 6th. Right now one of the Democrats’ talking points is that Trump doesn’t respect the judicial system (because of his attacks on the absurd outcome of the Manhattan trial). They are probably hoping that the Supreme Court fails to take any action before the November election, so they don’t have to defy any ruling that benefits Trump. The Court is gun-shy after all the attacks they received after they stopped the recounts in December 2000, which allowed Bush to become President, so they wouldn’t want to be seen as doing something that might benefit Trump.

During the debate Trump should violate the gag order and speak his mind to the American people.
Then he should declare that federal election law overrules a local "acting" county judge's gag order after the verdict has been given, and he will now consider himself free to speak when campaigning to be elected President.

A few seconds of the liars on CNN showed them agreeing that Trump “endangers” the court staff, judge, prosecutor staff and others-—by his words. And claims the words will bring our Deplorables to do violence.

Is sentencing a part of the trial?
They’ll do it and once it makes it’s way to the court system, in three years, it’ll be declared unconstitutional.
