Chief Justice Roberts orders DOJ to respond to Steve Bannon emergency request by June 26.

Some mildly good news for Bannon.

Chief Justice Roberts has ordered the Biden DOJ to respond to the emergency stay application to keep him out of jail by 4 pm this coming Wednesday, June 26, 2024 at 4 pm.

At that point, Steve’s clock will have ticked down to 4 days left before his prison report date of 7/1/24.

The House must file an amicus brief in support of June 26. The evening of June 26 is when the Supreme Court (or Chief Justice Roberts acting on his own) will start considering the stay application.

The House must be on file before the Supreme Court starts that process for its views to be heard.

Government officials should be required to comply with legislative subpoenas, but a private citizen should not be required to do so. A private citizen who declines to show up should be construed to be a refusal to show up as asserting a 5th Amendment right to not testify.

Roberts can halt the whole prcess and issue a writ of Habeus Corpus with a Writ of Certiorari in aid.

Thats what will likley happen if the DOJ does not file.

This also bodes well for Trumps coming immunity case decision. Bannon’s defense was based on Trumps immunity, so was Navarros.

Both Navarro and Bannon will be reesaed from their jail Sentences??

Reading the tea leaves here.

True but high level agency positions are political/managerial ones in nature. All they require is approval by the senate.

There is no formal or Constitutional requirement for an AG to have a law degree, nor their deputies.

One similar example is the position of Surgeon General. They do not have to be a surgeon (and that has been the case before).

In Navarro’s case, not being a lawyer could become problematic for him, but its not firm road block either.

Peter Navarro is a DEMOCRAT

Navarro became a Republican in 2018, and remains a Republican, which is why he is now in prison. Before that, he was an activist Democrat (1994-2018). Before that, he was an Independent (1991-1994). Before that, he was a registered Republican.

Let’s return to this thread in a few days. It was Robert’s Court that took a pass on hearing the facts of the steal in Dec. 2020 which led to these unconstitutional cases against Trump and his braintrust. What would possess him to reverse course now?

I think that Navarro or Bannon would probably be great choices for Attorney General. Both have a lot of experience with our “justice system” I don’t think that either will pull a Session or Bill Barr either. In fact, Trump might need those pointy choke collars for each of them. Not that the collars should be used.

He has a differet array of colleagues on the court steering his persomal train towards the law.

HIs refusal to heart those cases have almost ruined ojur country entirely. Maybe he has buyer’s remorse, LOL.

The House has a resolution pending vacating the subpoena underlying the contempt case. In these circumstances, it would be absurd for the House to join the DOJ’s opposition to the Stay. I’d expect Johnson to join Bannon in support instead.
