The Christian right is coming for divorce next

Before the 1960s, it was really hard to get divorced in America.

Typically, the only way to do it was to convince a judge that your spouse had committed some form of wrongdoing, like adultery, abandonment, or “cruelty” (that is, abuse). This could be difficult: “Even if you could prove you had been hit, that didn’t necessarily mean it rose to the level of cruelty that justified a divorce,” said Marcia Zug, a family law professor at the University of South Carolina.

Then came a revolution: In 1969, then-Gov. Ronald Reagan of California (who was himself divorced) signed the nation’s first no-fault divorce law, allowing people to end their marriages without proving they’d been wronged. The move was a recognition that “people were going to get out of marriages,” Zug said, and gave them a way to do that without resorting to subterfuge. Similar laws soon swept the country, and rates of domestic violence and spousal murder began to drop as people — especially women — gained more freedom to leave dangerous situations.

Today, … a counter-revolution is brewing: Conservative commentators and lawmakers are calling for an end to no-fault divorce, arguing that it has harmed men and even destroyed the fabric of society.

My DIL started having sex with another guy. She moved out, abandoned their kids for 2 years...and when my son finally filed for divorce, her behavior could not be mentioned in court.

Nor could he mention she had claimed the kids on her taxes while living in another state and it took 2 years for the IRS to lower the hammer. She still owes on back taxes and COVID false payments...

Theres a physical danger to the girls if the mom is the cheater and guys come around. Not really the same thing with boys.

If they arent tossed out, prenups can address asset spilts in the event of adultery,as well as debt.

In my work I have found that WOMEN initiate legal proceedings because men do not. A separated man is in a good place.... sort of available. Disconnected from wife. No reason to legalize the split unless wife is very difficult.

A separated woman has difficulty twisting in such an unsettled state. She often feels the legal connection between them and needs clarity.

Just 40 years of work and observation

I bet we're all saying the same thing, but in a different way. We all think there should be penalties for breaking up a marriage, right? And to be clear, I mean the person who abandons, cheats on, or endangers the other spouse is the one who breaks up the marriage. (The person who was abandoned, cheated on, or endangered is not at fault.)

Anyone can file a "fault" divorce today, instead of a "no fault" divorce. The problem is the outcome will be the same. The court will not care who broke up the marriage or why. The end result will be the same. The only difference is that fault divorce costs more time and money, and all the dirty laundry is aired in court.

It still is.

The alternative that society chose - mortal sin - is gravely wrong.

I fear society likes divorce.

We can do better.

They generally don’t cheat with the target’s mom. Which was the context we were talking about.

Do the research. Girls are far more at risk of a cheating spouses’ affair partner than boys.

Its a good idea, but judges can toss them so its not a guarantee.

You need to actually videotape the prenup signings with the lawyers, and have both people discussing it, and saying they aren’t under duress, and understand each part of the prenups. Preferably walking throgh each section and asking if there are questions, and if each understand each section.

I also believe paternity testing should be routine and mandatory. Not only for fraud/cheating reasons, but for potential future health issues like needing organs or blood donations from parents, which does occur. You don’t want to be a guy and find out during a medical crisis the kid your wife frauded/cucked you to velieve is yours, isn’t yours.

God didn’t invent divorce - Moses did. God says in Malachi that he hates divorce, and Jesus said that anyone who divorced his wife other than for reasons of adultery and married another was guilty of adultery.

The quoted stat is 25% of divorces are driven by abuse.

What about the other 75%?

Keeping divorce to avoid murder is like keeping abortion for rape or incest.
