Texas court asked to reverse pardon in Black Lives Matter protest killing

June 4 (Reuters) - A Texas prosecutor asked the state's highest criminal court on Tuesday to reverse a pardon granted by Governor Gregg Abbott to a former U.S. Army sergeant convicted of murder and sentenced to prison for fatally shooting a Black Lives Matter protester. Travis County District Attorney Jose Garza, a Democrat whose office tried the murder case, said he asked the state Court of Criminal Appeals for a special order, called a writ of mandamus, to overturn Abbott's action.

Garza told a news briefing in the state capital of Austin that Abbott, a Republican, violated the separation of powers doctrine of the state's constitution and failed to follow proper legal procedures in the way he pardoned Daniel Perry last month. Abbott's office did not immediately respond to Reuters' request seeking comment on Garza's move. Perry, convicted last year, was sentenced to 25 years in prison for fatally shooting Garrett Foster, a U.S. Air Force veteran, in July 2020 during the protest against racial injustice following the George Floyd killing by police in Minneapolis months earlier.

This is the first update I have seen on this case. Daniel Perry, the defendant, justifiably killed the decedent after the decedent pointed an AK-47 at him. This was after the decedent and a threatening mob surrounded Perry's vehicle. Perry was pardoned last month, according to this article. Indeed, before he was persecuted, the then state's attorney in Austin had refused to prosecute the case against Perry. Instead, the current state's attorney, a Soros plant, was elected and chose to revive this horrible case.

All law against thee, and no laws for me.
All persecution against thee, no arrests for me.

MLK was only arrested 29 times by racist local Democrat party law enforcement, and most of those charges were later dropped. Trump was persecuted and convicted of 34 felonies for writing one check to his lawyer.

False. The governor has the power of pardon. There is a committee he sends the case to first. The committee made its recommendation (which is non binding) and then Abbot pardoned him.

He never should have been prosecuted in the first place. There is zero chance he would have been charged anywhere else in Texas other than the blue shithole that is Austin.

In fact, there was another Klantifa member who shot at Perry’s car as he drove away. That guy should have been charged with attempted murder. He has no claim of self defense like Perry.

Is there some way for the state of Texas to remove a rogue prosecutor? If so, they should remove this guy. He’s a disgrace.

I think we could stop with, the governor has the power to pardon.

Would you happen to know if Texas law requires the governor to have a committee at all? Noted that the committee’s rec is non-binding. But is the governor required to have a committee? Certainly the historic common law country right for the chief exec to pardon has been unfettered. It’s just an inherent right, part of the whole checks and balances / separation of powers set up.

Reuters made sure to say that the BLM protester who was shot was a veteran, BUT strangely did not mention that Daniel Perry was a U.S. Army Sergeant at the time.

I believe Texas does require a committee review the case and make a recommendation first. Abbot said that was the only thing preventing him from pardoning Perry sooner.

This miserable excuse of a human being was NOT killed by police; he was already dying from an overdose of numerous drugs and was not “murdered” as so many in the media still say...

First thing I’d do to answer this suit is file a motion to dismiss as Garza has no standing.

And claiming separation of powers?? On what basis? This is an executive branch decision: wholly and completely.

Question - where in the Texas constitution does the power to reverse a pardon get granted to the Texas Supreme court? ‘Cause I cant find it.

Another question: If the Court feels they can over ride a Gov. Pardon.
Then can a Gov. override a Courts ruling.
