The key moment won’t be when New York Supreme Court Justice Juan Merchan finishes offering instructions to the jury in Donald Trump’s criminal trial in Manhattan. It won’t be when the jury files out of the courtroom, slated to return only when it has reached a verdict. The key moment, the moment in which the jury’s power flips from potential to kinetic, comes when the officer escorts the jury to the jury room and the door shuts with a click........

What we did (if I remember correctly 15 years later) was begin with a survey of the different charges and run through a trial vote on the defendants’ guilt. (Marshall was charged along with his attorney Francis Marshall.) We immediately realized that the deliberations would not be quick.

It’s crucial to remember that the task presented to jurors is not simply to answer the question, “Did he do it,” but instead the more particular question, “Does the evidence presented remove any reasonable doubt that he violated the letter of the law?” In the jury box, you’re thinking mostly about the first question. In the jury room, after that door click, you’re considering the second one. That’s the point of the judge’s instructions......

What the jurors can’t and shouldn’t do is consider what the ramifications of their decision will be. They aren’t being asked to punish Trump but, instead, to evaluate his guilt based on the available evidence. This is why the judge was frustrated at Trump’s attorney Todd Blanche on Tuesday; Blanche made a comment that Trump might face prison time, tying the verdict to a punishment in a way that could influence how jurors vote on the charges.

Trump’s best chances will come when an appeals court overrules the idiotic and biased verdict that is coming next.

Biden is counting on any appellate overturning of the verdict to be after the election and for the guilty verdict to enable him to get a narrow victory in November.

What the public's reaction to that will be, assuming the verdict is overturned, is hard to say. I would assume the administration is already planning for public outrage and will treat people expressing outrage as insurrectionists.

Oh FFS - I’ve seen no evidence Bump has any legal training.

If this were a normal legal case, the prosecution would have to prove each element of the underlying crime beyond a reasonable doubt. Here, they’ve never alleged a singular “crime” which supports the foundation transforming this into a felony versus a misdemeanor. And only a felony could trigger the new - and Constitutionally dubious - felony statute of limitations they put in just so they could go after Trump.

Calling this a miscarriage of justice doesn’t begin to get to just how corrupt and abusive this case has been.

Details on the NY State judiciary levels:

1.) the NY State Supreme Court is NOT the highest Court in NY State. It is a statewide trial court jurisdictionally, and as such is a common trial court. Can’t get a divorce in NY State without it coming before the “Supreme” Court. So— it is small potatoes.
the true power (and it is political as hell) is the NY Court of Appeals.

2.) The NY Appeals Court is OVER the Supreme. Merchan is an apparatchik of the State of New York.

He should be removed from the bench. Period and for Life!

Blanche put pay to that-— Big Time! They WILL be thinking of “what happens to me if I make this idiotic decision, based on NO known US law. Unconstitutional “made up” Merchan Colombian law.... Dem machine Tammany “law” we are back there and this is Five Points Gangs of New York re-visited and installed.

To amplify this a bit - New York has the usual three tiers, but they have different and unusual names than most people are used to. The "Supreme Court" in New York is the LOWEST level - it's equivalent to a District Court in the federal system. Their second level is the "Appellate Division", which is equal to a US Court of Appeals. Their highest level is oddly called the "Court of Appeals", even though that is their equivalent to the US Supreme Court.

This whole litigation has been designed to attempt to get a guilty verdict before the 2024 election, with the wink and nod that the reversal - at either one of the NY appellate levels or at the US Supreme Court - will take time.

I think this comment is generally fair if presented in the proper context, e.g. "remember, a man may go to prison if you don't do your duty and find no reasonable doubt in your mind". That's the way the system works. If there is reasonable doubt, you must let him out.

50 years ago NY’s highest court was officially called The Court of Final Appeals. But folks thought that moniker was a bit too grisly. Raised images of Old Sparky in Sing Sing.

The jurors will spend just enough time, online, to check their off-shore accounts...

They will also have to verify that the contracts on their family members has been canceled...

As soon as they get a ka-ching, they’ll come in with the verdict they were paid to produce...

The first act should be an immediate guilty/not guilty "secret" vote and go from there.

IF there is one "not guilty", they have to deal with THAT one first and if THAT one is concerned about being tagged forever a traitor . . . . others may think twice about a guilty vote.

No idea which, seein' as it's New Yawk.
