House Minority Leader Hakeem Jeffries (D-NY) said on Friday on MSNBC’s “Deadline” that if the Supreme Court can overturn Roe v. Wade, then “democracy can fall.”
Jeffries said, “It’s important for the American people to understand that if Roe v. Wade can fall, anything can fall. Social Security itself can fall. Medicare can fall. The Affordable Care Act can fall. Democracy can fall. Brown v. Board of Education can fall, as Justice Thomas made clear in his concurring observation and opinion yesterday. So, everything we care about is going to be on the ballot in November. Including getting the federal judiciary into a place where it can actually administer the law and make decisions in a fair and impartial fashion, not lead an ideological effort to jam their right-wing views down the throats of the American people.”

But allowing each state to vote on what to do with abortion is NOT democracy?

Interesting in that all four of the markers of democracy that Jeffries cites were Democrat initiatives. Also interesting that when SCOTUS struck down Plessy v Ferguson in Brown v Board of Education, SCOTUS was striking down yet another democrat party initiative.
The Constitution doesn’t matter. This is what matters:

When Ruth Bader Ginsberg in the 1990s wrote the opinion for the “right to die”/“doctor-assisted suicide” decision, that was all the precedent needed for overturning Roe versus Wade. It’s a “living Constitution” according to the press & the crying Chuck Schumers…….based on precedent. Ginsberg decided that medical doctors are NOT above the law, that the State has the obligation to protect innocent life, and patients have no right to be killed by their doctors. Moreover, Ginsberg explicitly argued that our Constitution does NOT have “positive rights” only negative ones—-ie the Constitution does not say what government should do for us, but only want it cannot do to us.”——anonymous

Hakim Jeffries could actually take the advice from Justice Ginsburg and codify the abortion process. But, I guess it is easier to whine than it is to build a coalition.
