“President Trump has an 8th Amendment challenge to the unconstitutional fines levied against him by a rogue judge,” Constitutional Scholar Mark Levin noted Tuesday, commenting on the extraordinary $370 million fine (including interest) imposed by a New York judge.
Later that day, former President Trump posted the text of the 8th Amendment on TruthSocial.com platform, later linking to the same article linked by Levin in his comment posted on X (formerly Twitter). […]
As Levin, (Arthur) Fergenson, (Jonathan) Turley, (Steven) Calabresi and a host of other constitutional experts have noted, the fine is extraordinary not only because of its unprecedented size, but also because it punishes Trump for a fraud conviction in which no one was actually defrauded. …

It’s very excessive. If anyone should be fined and convicted, it’s that evil old war criminal Gyorgy Schwartz.
There has to be laws against all this? I mean I get this is now a two tiered banana republic but back in the days of the constitution, can anyone fight this?
Alex Jones’ amount was $1.5 billion.
The whole fraud by the AG, prosecution & the judge is to interfere in an election. I hope they all are disbarred, and fined. I furthermore hope that New York State Governor is imprisoned.
FINALLY! Somebody else is using the 8th amendment.
That is PRECISELY what it is for, so the government cannot intentionally bankrupt a citizen.
I agree. And it doesn’t require millions to initiate. And since it’s a federal issue the case can be filed anywhere in the US (like Texas). It’s the way to go if Trump’s lawyers can get a federal judge to stay the fine. But then I’m not a lawyer, not even on TV.
“Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.”
From the article.
He should have appealed on this basis.
Don’t be so sure he’ll be successful here in Texas. We too have our political motivated thorns in our sides liberal black robes. He needs to stay away from Austin that’s for sure. I don’t know where else he would get a fair minded judge in Texas that’s federal. But I don’t know nothing about the law.
From the Constitution.
Maybe my expectations are too high, but I presumed most Freepers have memorized this?
Cruel and unusual punishment…. So we can’t haul the judge to gitmo and put him with the islamist inmates?
IMHO it’s also unconstitutional because he must put the fine plus interest in an escrow account immediately, effectively limiting his ability to mount an appeal. First I’ve ever heard where this was demanded by the court to comply with an unconstitutional law.
Posted for clarity :-)
Can and will Trump appeal this direct to the court of appeals or the supreme court without having to post the bond first?
Musk just moved his business out of Delaware because they gave him the shaft...so he gets it...
Heard Dan Bongino ask “how many previous people have been charged with this in New York?”
Answer: None.
That may help an appeal that it’s excessive.
This is like those two punitive divorce decrees against Norman Mailer where the two different sobbing wives who had only had extremely low level bit parts and work as extras in movies and plays were delighted to get a fortune from the husband who supposedly caused each to give up the chance to go to he very pinnacle of stardom and make millions due to raising children. Mailer said: “It is so pitiful the American public had been deprived of such classic talent on the dramatic stage.”
Wasn’t it the Texas Supreme Court that took Jeff Younger’s son away so he could be castrated in California?
Pretty sure it was.
These days no place is reliably sane.
Trump posting the Declaration of Independence would be more newsworthy..
Thanks on behalf of whomever needs it.
