President Joe Biden took to the microphone for an unannounced address on Thursday night, following the release of the politically devastating Special Counsel report that said he "willfully retained and disclosed classified materials after his vice presidency when he was a private citizen." While the report stated that such actions "present serious risks to national security,” Biden will not face charges because he presents himself as an “elderly man with a poor memory” and it would be difficult to convince a jury he is guilty of a serious felony because to commit such a crime “requires a mental state of willfulness.” The report elaborated by pointing out he couldn’t even remember when he was vice president and didn’t even remember when his son Beau died.
The address was scheduled for 7:45 p.m. but did not actually get underway until around 8 — well past his usual 7 p.m. bedtime.
I can't explain how or why Biden's handlers felt it was a good idea to trot him out at night to talk about the special counsel report, but it did not go well. He was belligerent and defensive, and it was a terrible look. When he addressed the report claiming that he couldn't remember when his son died, it really got bad.
"How in the hell dare he raise that," Biden said angrily, concluding that it is "none of their damn business."
"For any extraneous commentary, they don't know what they're talking about," Biden insisted, even though the report presented direct quotes. "It has no place in this report."
Biden also blamed his staff for storing classified documents in his home, office, and garage, insisting, "I take responsibility for not having seen exactly what my staff would do!"

That is true but in the last seven days I think everyone knows Biden cannot remain in a position of authority. That will be Harris and that is how she will show up at the convention.

Here is how this went down……when Joe was being interviewed and needed an excuse as to why he had the docs, he said, “ I don’t remember, my son beau had brain cancer and then died, it was a very confusing and difficult time for me”. The interviewer then asked, “what was the date of your sons illness and death” Joe couldn’t remember OR giving the the dates wouldn’t have fit into his time frame”. Afterall, it wouldn’t be the first time he used poor Beau as an excuse or to get sympathy.
I can understand Hur closing the case. Just like Comey refused to bring charges against Hillary for her obvious misuse of classified information.
But state the real reason. Comey alluded to it, as did Hur (his 'he's a demented incompetent old coot' comment aside), but neither stated it clearly:
A Jury in Washington DC will never convict a Democrat politician, no matter what the evidence. Bringing up charges would be a futile exercise. The citizenry in Washington DC is hopelessly partisan and crooked. The only solution, short of razing the town to the ground and salting it, is to move trials elsewhere. You can never get a fair trial in DC because the people are crooked.

That is true, as far as whether or not he is actually guilty, but it is not true when determining whether or not to prosecute. He has to be able to assist in his own defense, and his ability to do that is questionable. That's why invoking the 25th Amendment has been put on the table, even by some Democrats.
It's interesting, though, that he acknowledges that he is old, but he asserts that his memory is fine. So he can't now present himself to a jury the way Hur hypothesized he would. In my book, that puts prosecution back on the table.
There is still, however, the fact that the DOJ has a policy against prosecuting sitting presidents. So the earliest this could happen would be the afternoon of 1/20/2025.
After the last week, given the way the world is today, I cannot see how even the most loyal Prog would be comfortable with Biden as POTUS.
And we knew about it a year ago. The man belongs in a prison cell, with Hillary Clinton as his bunkie ...
But neither one will ever even be prosecuted. NOBODY with the power to do it has any interest in the task.

About an hour ago I posted this on another FR thread:
As a public service, I just checked a few “progressive” websites. Almost everyone there said Biden did great tonight. “Forceful.” “Sharp as a tack.”
I wish I were kidding. But I’m not.
I think everyone overestimates Jill’s role in all this. Yes she adores the trappings of first lady but she doesn’t come across as too bright or especially devious, just selfish.
The same excuse they accuse Trump of didn't stop them from prosecuting him, now did it.
