On Wednesday, Representative Joaquin Castro (D-TX) called on President Biden to "seize" the Texas National Guard by calling them into Federal service, removing them from the command and control of the State of Texas. This is presumably in response to Texas Governor Greg Abbott's defiant tone towards the Biden Administration on closing the border.
A Texas congressman has urged President Biden to take the state's National Guard under federal control if Republican Governor Greg Abbott defies a Supreme Court ruling allowing federal agents to remove razor wire from a section of the U.S.-Mexico border.
The call was made by Democratic Representative Joaquin Castro after Abbott posted on X, formerly Twitter, saying the Texas National Guard would continue to "hold the line in Eagle's Pass," a popular migrant crossing point, stating: "Texas will not back down from our efforts to secure the border in Biden's absence."
Castro re-shared Abbott's post on his own X account, adding: "Governor Greg Abbott is using the Texas National Guard to obstruct and create chaos at the border.
As of this writing, there has been no action on this by the Biden Administration.
This idea by Rep. Castro raises some interesting questions:
1) Were the President to activate the Texas National Guard under Title 10, what would their orders be? To assist federal officers in throwing open the gates?
2)What happens if members of the Texas National Guard refuse activation and instead continue to follow the orders of TX-ANG officers and Governor Abbott?
3)What if the Texas Guard splits, and former comrades end up facing each other across that red line?

The court basically said that federal prosecutors had “prosecutorial discretion” over where to spend their efforts (e.g., which illegals to prosecute and/or deport), and any state law infringes on the federal agencies’ authority to exercise discretion.
Failure to enforce is passive.

While the word "invasion" that Texas Gov. Abbott used for the border is referenced in the Constitution, "national emergency" is not found in the Constitution.
"Article I, Section 10, Clause 3: No State shall, without the Consent of Congress, lay any Duty of Tonnage, keep Troops, or Ships of War in time of Peace, enter into any Agreement or Compact with another State, or with a foreign Power, or engage in War, unless actually invaded, or in such imminent Danger as will not admit of delay [emphasis added]."
Activist President Woodrow Wilson was possibly taking advantage of wartime mayhem (WWI) when he signed the Democratic Congress's unconstitutional (imo) bill that permanently gave any POTUS the unilateral power to declare national emergencies.
In fact, Wilson seems to have ignored that the states have never expressly constitutionally given the federal government the specific power to dictate national response to non-wartime emergencies. And even if the states had given the feds such power, just like the drafters of the Constitution decided not to give POTUS unilateral power to declare war, neither would they give POTUS unilateral power to POTUS to dictate federal response to emergencies.

After all, since House uniquely has the power of the purse, Congress first has to decide to spend taxpayer dollars to pay for wars or responses to emergencies, regardless what POTUS advises Congress to do.
Again, POTUS has no express constitutional power to unilaterally decide the nation's involvement in wars or national emergencies imo.
The real problem with the invasion at Texas border is this imo. The corrupt, self-serving, constitutionally undefined political parties that have pirated control of state and federal governments are once again scamming the American people, this time by letting Biden get away with unconstitutional interference in the constitutionally enumerated power of the sovereign states to protect themselves from invasion.
If I am not mistaken, they gave Governor Abbott until tomorrow to turn over Eagle Pass to the feds, but there’s just one small problem. They calculated it to where Abbott would be out of the state….I believe he’s flying or is in the air right now, on his way to India. Something is fishy here. Why would he leave when Tx is in an extraordinary explosive situation? Can somebody tell me here if I am mistaken that he is on his way to India right now. Correct me if I’m wrong.
The SCOTUS ruling was on an emergency appeal by Biden pending a case that will be heard later. In this case, SCOTUS allowed Biden to continue to cut the wires while the appeal is in progress.I thought that the courts usually prevent one party from continuing to be destructive to the other party while a case is pending. In this case, SCOTUS is letting Biden continue to tear down Texas border obstructions while the case works it way to SCOTUS.
It's like a court letting an abusive spouse continue to beat his wife while the divorce proceedings are in progress instead of approving the restraining order to keep away while the case is pending.
