On Wednesday, Representative Joaquin Castro (D-TX) called on President Biden to "seize" the Texas National Guard by calling them into Federal service, removing them from the command and control of the State of Texas. This is presumably in response to Texas Governor Greg Abbott's defiant tone towards the Biden Administration on closing the border.
A Texas congressman has urged President Biden to take the state's National Guard under federal control if Republican Governor Greg Abbott defies a Supreme Court ruling allowing federal agents to remove razor wire from a section of the U.S.-Mexico border.
The call was made by Democratic Representative Joaquin Castro after Abbott posted on X, formerly Twitter, saying the Texas National Guard would continue to "hold the line in Eagle's Pass," a popular migrant crossing point, stating: "Texas will not back down from our efforts to secure the border in Biden's absence."
Castro re-shared Abbott's post on his own X account, adding: "Governor Greg Abbott is using the Texas National Guard to obstruct and create chaos at the border.
As of this writing, there has been no action on this by the Biden Administration.
This idea by Rep. Castro raises some interesting questions:
1) Were the President to activate the Texas National Guard under Title 10, what would their orders be? To assist federal officers in throwing open the gates?
2)What happens if members of the Texas National Guard refuse activation and instead continue to follow the orders of TX-ANG officers and Governor Abbott?
3)What if the Texas Guard splits, and former comrades end up facing each other across that red line?
4)If the Pentagon sends federal troops... SNIP>>>>>>>>>>>>>>

Congress has the power to “make rules concerning captures on land and water”.
“Congress shall have power to...establish a uniform rule of naturalization.”
Last time I checked, the executive branch wasn’t Congress. It’s called the “executive” because its authority is to execute the laws that Congress passes. Also last time I checked, choosing to NOT execute those laws, and in fact to overtly break them, most certainly doesn’t entitle the executive to federal preemption over sovereign states that are desperately trying to defend their citizens FROM the result of the executives’ extra-legal actions.
Biden’s despotic actions to actually interfere with duly-enacted border laws places him and his “administration” outside their constitutional authority, and thus should entitle their evil efforts to NO protection via federal preemption. He and his minions are acting as criminals, not as legitimate representatives of the people.
Abbot MUST stick to his guns, no matter what the corrupt, tyrannical federal government attempts to do. If the feds take even the slightest step to try to impose their will on Texas by force, then not only SHOULD this become the flashpoint for a civil war, but it MUST become exactly that. Biden’s puppet masters can try to appeal to “preemption” and use a few morally-confused “justices” to endorse it all they want, but they are ALL operating WAY outside the intent of this nation’s founders, and should be ignored. If they don’t like being ignored and decide to use force to press their despotism, then far more than just Texas should rise to slap them down hard via any means necessary. It should be no surprise that we are at this sorry point; it has been coming for a long time, and I don’t see any peaceful resolution possible.
Does anyone really believe that the anti-American globalist tyrants, in either party, will EVER stop their assault on this country just because of some well-reasoned argument, or even because of legitimate attempts to tie their hands with laws? They don’t even obey the multitude of laws we already have, and the reason they so casually disregard them is because they don’t FEAR the people, as represented through their sovereign states. Today’s thoroughly corrupted caricature of a federal government needs to be taught their actual constitutional role, its significant limitations, and especially who their boss is, namely the States. We are not their subjects! They do OUR bidding, not the other way around, and Texas can take a big step toward reminding them of it.
“Biden and the Border Patrol have a legal right under US and Texas law to cut down razor wire at the border. 10 miles away? No rights at all. None.”
I would argue that the protection of the border transcends a federal government that is in violation of the Constitution. The federal government has made itself illegitimate. Your silly law does not apply now.
Except the State Guard and the National Guard are not the same thing. The webpage is very clear to differentiate between the two.

When was the last time the rat 🐀 bastards paid any attention to the Constitution?
She is somewhere in the back 40, playing switch. 😆
There will be no “civil war”.
Is it possible, in the vein of “is it possible I may win 1 million dollars”? Yes.
Is it probable? No. Not likely or imminent or unavoidable.
Unfortunately Congress has abdicated authority that they have to use Impeachment to punish. There’s lots of foot dragging now to even impeach Mayorkas.
That the issue is as serious as it is demands purposeful responses by House Republicans to use all the levers within their control to address the immigration crusts at the U.S. border. That means (to me) it’s appropriate to hold Ukraine funding “hostage” to enact meaningful U.S. border corrective actions. Of the two issues, U.S. border security is clearly (to me) the more imperative issue.
We’ll see if House Republicans are up to the challenge.
Traitors to this country used to be executed. We need to return to that type of normalcy.
In addition, those attempting to cross the border should be shot! Continue shooting until the invasion stops.
you forgot hippos..the most most dangerous water creature
"DANGER RIFLE RANGE KEEP OUT"
It boils down to this... Is Texas at war? Historically war did not always mean physical combat. The Romans were at war with the Picts and Hadrian’s wall was the battle front for decades. Most of the time the war was not fought as physical combat. The Picts favorite weapons were sending diseased women, poisoned food, infiltrators, criminals, and thieves to the Romans behind Hadrian’s wall. Sound familiar? Non combative “cold war”, but a perpetual long lasting war campaign none the less.
Texas Constitution.
Article I
Bill of rights
Sec. 1. FREEDOM AND SOVEREIGNTY OF STATE. Texas is a free and independent State, subject only to the Constitution of the United States, and the maintenance of our free institutions and the perpetuity of the Union depend upon the preservation of the right of local self-government, unimpaired to all the States. (Feb. 15, 1876.)

The officer must make the call in writing and shall immediately notify the governor of the action.
Acts 1987, 70th Leg., ch. 147, Sec. 1, eff. Sept. 1, 1987.
8 more. Texas has 2 now.
Its getting close to Bonnie Blue Flag time. If Texas leave the Union—what other states will follow?
Along with the cartels.
Nothing stopping them from going back to plain old barbed wire.
Feferalizing the Guard back in the 1900 was an attack on states’ rights.
The more that is under feferal control the less freedom for everyone.
It’s an election year and they’re losing. They want an “emergency.”
Yes. But I don't think this is going to go how they think it will go.
I agree. Besides, I think a potential Biden federalization of the Texas National Guard to be used in the United States would be problematic wrt the Posse Comitatus Act.
The only excuse for that as an ‘emergency’ would be the Fed’s admission that it wasn’t doing its job in the first place - protecting the US from external invasion.
That, or they want an excuse to try to suspend the 2024 election.
