Harney County judge puts permanent injunction on Measure 114

On Tuesday, a judge in Harney County declared that the gun safety law Measure 114 passed by Oregon voters was unconstitutional.

Circuit Court Judge Robert S. Raschio imposed a permanent injunction against Measure 114, essentially putting it on hold until further notice.

Since M114 was narrowly approved by voters in November 2022 it has been pending in federal and state courts.

Under the law a person must pass a gun safety course and have their criminal history checked before they can buy a gun. Also, magazines with a capacity greater than ten rounds are prohibited.

Those in support of the law including state attorneys argue the new rules would reduce killings, suicides, and mass shootings; however, Raschio stated they were unable to prove how any of the provisions would increase public safety.

A federal judge in Oregon determined in a different trial earlier this year that the measure did not violate the Second Amendment to the United States Constitution, but her decision does not overrule the state case.

And he’s absolutely correct.
The existing laws don’t do anything, and the new “law” won’t do anything either, would be enforced capriciously and without a lick of sense.

Hooray for Harney County! That’s one of my favorite parts of the state, being about as unlike Portland as can be imagined.

Correction. Salem, Ashland, and Portland passed measure 114.

A victory for Oregon and the libs are surely melting down. They LOVE when judges make laws in their favor. I doubt they will like this ruling.

This is definitely great news, but it’s not the end of it. From Kevin Starrett at Oregon Firearms Federation:

“While this good news buys us time, there is no doubt that the state is already working on an appeal to the ruling which will cost Oregon taxpayers even more millions. And keep in mind that Oregon’s Appeals Court includes Judge Jim Egan who has stated, in an unhinged rant, that gun owners are racist anti-semites. So there is still a long and expensive fight ahead. As we know, the totally compromised FBI has their fingers on the scale and, at the request of Oregon’s Department of “Justice,” broke the rules to offer Oregon a “grace period” to conduct fingerprint checks required by Mz 114 but which the FBI already admitted they were not allowed to conduct.”

It’s gonna be a long expensive battle.

Nearly all shootings in Oregon happens in north east Portland by a certain demographic. It is so bad Multnomah County, and eventually the whole state, forbids publishing mugshots because they were usually melanated peoples.
