U.S. Judge Lewis A. Kaplan says that former President Donald J. Trump may be said to have “raped” E. Jean Carroll, even though a jury specifically declined to find that he had done so in his recent civil trial in New York.
Aaron Blake of the Washington Post reported the judge’s finding — approvingly, calling it a “clarification”:
[Kaplan] says that what the jury found Trump did was in fact rape, as commonly understood.
The filing from Judge Lewis A. Kaplan came as Trump’s attorneys have sought a new trial and have argued that the jury’s $5 million verdict against Trump in the civil suit was excessive. The reason, they argue, is that sexual abuse could be as limited as the “groping” of a victim’s breasts.

“The finding that Ms. Carroll failed to prove that she was ‘raped’ within the meaning of the New York Penal Law does not mean that she failed to prove that Mr. Trump ‘raped’ her as many people commonly understand the word ‘rape,’ ” Kaplan wrote.
The jury found that Trump had not raped Carroll, but found him liable for sexual abuse and battery, based on claims about an encounter in a department store dressing room, though Carroll could not remember the year

Needs repeating- the judge violated their OATH before God and country to uphold the rule of law and make sure a fair trial happened. The judge is an agent of evil for violating that oath out of personal bias- God is very serious when he warns judges to be impartial and honest and fair!

I don’t know the law on this matter, but I believe that when a judge is on his on time, not on the bench, he can be held accountable for libel or slander.

Yes, in that case, the defense agrees to let the judge decide. They don’t have a jury trial and ignore it’s decision.
By a preponderance of the evidence, I say screw the evidence./s
If you did not have a jury then the following sentence would be untrue:
“There was a trial by jury and it was decided that Trump raped Carrol”
But thanks to having a jury, that sentence is now accurate.
“There was a trial by jury and it was decided that Trump raped Carrol”
Huh? There was a civil trial. The jury decided that Trump sexually assaulted Carrol, but did not rape her.
This judge took a page from Judge Sullivan in the Flynn case, throwing in for one side without shame.
This gives Trump more traction for appeal.

WHEN a close member of the judge’s family ACTUALLY GETS RAPED——MAYBE she can explain the DETAILS to the judge.
