Exclusive: Trump Pledges Executive Order on ‘Day One’ of Presidency to End Birthright Citizenship for Illegal Aliens, ‘Birth Tourism’

Former President Donald Trump, the GOP frontrunner for president in 2024, rolled out a new policy pledge on Tuesday in which he promised if elected he would sign an executive order on day one of his second term in office effectively ending birthright citizenship for illegal aliens and so-called “birth tourism.”

The policy proposal, contained in one of his Agenda 47 videos his campaign released, was obtained exclusively by Breitbart News ahead of its public release.

“As part of my plan to secure the border, on day one of my new term in office I will sign an executive order making clear to federal agencies that under the correct interpretation of the law going forward the future children of illegal aliens will not receive automatic U.S. citizenship,” Trump says in the slightly more than three-minute-long video.

Trump argues that birthright citizenship for children of illegal aliens serves as a “magnet” and an “incentive” for future prospective migrants to attempt to enter the country illegally.

“Joe Biden has launched an illegal foreign invasion of our country allowing a record number of illegal aliens to storm across our borders,” Trump says in the video. “From all over the world, they came. Under Biden’s current policies, even though these millions of illegal border crossers have entered the country unlawfully, all of their future children will become automatic U.S. citizens. Can you imagine? They’ll be eligible for welfare, taxpayer-funded healthcare, the right to vote, chain migration, and countless other government benefits, many of which will also profit the illegal alien parents. This policy is a reward for breaking the laws of the United States and is obviously a magnet helping draw the flood of illegals across our borders. They come by the millions and millions and millions.”

Regardless, I believe that an EO that interprets the 14th Amendment in the way that President Trump wants it interpreted will be put on hold due to a national injunction.

True, but there’s nothing that says during the executive order that a bill couldn’t be drafted to replace the EO with legislation and a congressional vote.

Jurisdiction in regards to criminal activity is not the same as jurisdiction in regards to automatic birth citizenship.

If I am from Mongolia and travel to Texas to commit a crime, the cops aren’t going to call the Mongolia state police to charge me. They don’t care where I come from, nor my immigration status. They only care that I broke the law in their locality. So are they going to tell me that since I am in their custody (awaiting trial) I can give birth citizenship? It makes no sense and destroys the whole notion of citizenship.

Next, you’ll say that since humans are citizens of the world they are also therefor citizens off the planet earth so can claim to be citizens of ANY country.

Says you. You’ve yet to show anything that says there is some other meaning of “jurisdiction” as it appears in the 14th amendment. Until you can do that, I am going to continue to operate under the assumption that the word has the same meaning it always has elsewhere:

“The power and authority constitutionally conferred upon (or constitutionally recognized as existing in) a court or judge to pronounce the sentence of the law, or to award the remedies provided by law, upon a state of facts, proved or ad- mitted, referred to the tribunal for decision, and authorized by law to be the subject of investigation or action by that tribunal, and in favor of or against persons (or a res) who present themselves, or who are brought, before the court in some manner sanctioned by law as proper and sufficient.”

People dropping out kids after crossing our border are NOT subject to the jurisdiction thereof - and neither are their children.

They never have been. The idea of birthright citizenship comes from a BOOK written by an ex SC judge who suggested the idea - but the idea of birthright citizenship has never been tested in our courts.

Dood, under the jurisdiction thereof has nothing at all to do with the individual. It’s mostly a geography matter.

Sometime look up what can be done to you if you leave the country and return . . . and demand a search warrant before Border Control searches your bags.

You’re within the jurisdiction of the US because it is a geography thing. You have not processed into the US so you have no rights.

the territory or sphere of activity over which the legal authority of a court or other institution extends:

It doesn’t matter who the party is. A tourist from England in the US breaking a law falls within the jurisdiction of where it happened.

It doesn’t matter if his tourist visa expired. It doesn’t matter if he lost the visa. It doesn’t even matter if he smuggled in with no visa. He’s within the jurisdiction.

Executive order is meaningless and likely would be blocked by court before the ink dries. If not, it would be reversed as soon as he left office. No, the only way to address this is through legislation, which requires leadship. Sorry, not Trump’s strong suite.

Illegals aren’t under our jurisdiction thus we deport them.

If a British diplomat has a child while living here, that child is NOT a US citizen.

If an American has a child visiting France they are not French citizens.
